Nouvellement résidente de Sorel-Tracy depuis l'été dernier, j'ai rencontré ceux que je croyais être mes voisins. C'est Sam, un petit garçon de 4 ans, qui est venu cogner à ma porte en plein mois d'aout 2021. Mon mari ouvre, Sam lui dit "Ça ne sera pas long, garde la porte ouverte mes parents s'en viennent".

Voilà comment nous avons, mon mari et moi, fait connaissance de cette superbe famille : Evanir (36 ans), Sandra (30 ans), Jaimy (10 ans), Sam (4 ans), la petite dernière Séréna (1 an maintenant) et le chat Milo.
Malheureusement leur histoire m'amène à faire une campagne de financement, car prochainement, ils seront bien malgré eux, encore une fois, à la rue.
En 2020, ils étaient propriétaires d'une maison neuve à Sainte-Sophie.
Voulant se rapprocher du travail d'Evanir, ils font le choix de s'établir à Sorel-Tracy. Un promoteur sera le début de la fin pour eux. Suivant la signature d'un contrat préliminaire ainsi qu'un dépôt de 28 000$, les dés sont jetés. Pour eux c'était le début de la construction de leur maison de rêve, sans se douter que le rêve allait tourner au cauchemar.
Suivant le choix du promoteur (J.A.C. Construction/Maison Lagacé) et la signature du contrat en juin 2020, la livraison de la propriété étant garantie pour octobre 2020, le cauchemar débute :
1. Étant proactive, ayant confiance, notre belle famille vend sa propriété de Sainte-Sophie en juillet 2020.
2. En attendant, ils louent une RB&B jusqu'à octobre 2020, les meubles en entrepôt. Le promoteur leur ayant promis de les reloger dans leur maison modèle de Sorel-Tracy à la fin du contrat RB&B, le cas échéant.
3. La fin de la location RB&B arrive, la maison modèle n'est pas disponible, car occupée par une autre famille. Notre famille se retrouve à la rue pour la 1re fois en novembre 2020. Par chance, ils arrivent à prolonger le RB&B jusqu'à décembre 2020.
4. Les travaux débutent avec plus de 3 mois de retard, 1er décembre 2020! Livraison maintenant garantie pour mars 2021.
5. À noter, Sandra est enceinte, elle en est à son 6e mois de grossesse. Imaginer le stress et l'anxiété.
6. Le promoteur leur sous-loue, supposément jusqu'à septembre 2021, le logement d'une cliente à eux censé être meublé. Notre famille arrive, le logement est vide de meubles! Ils vont donc chercher leurs propres meubles à l'entrepôt, question d'avoir des lits pour dormir! Par la suite, notre famille engage des déménageurs en urgence pour le reste des meubles.
7. Le 20 février 2021, Séréna voit le jour. Un mois d'avance.
8. Évidemment livraison repoussée pour avril, mai, juin 2021. Entre-temps, le promoteur décide de résilier le bail au 1er juillet, garantissant la livraison au 1er juin 2021.
9. 1er juin 2021, le promoteur annonce que la propriété ne sera pas livrée à temps, peu être le 1er juillet. Ben coudonc!
10. Encore une fois, notre famille est à la rue. Pensez-y, un nouveau né, 2 jeunes enfant. Ils en sont à leur 3e déménagement en moins d'un an. Par chance, il y a de l'amour.
11. Le 21 juin 2021, le promoteur les convoque à son bureau afin de leur soutirer de l'argent supplémentaire. Que voulez-vous? La Covid a le dos large. Il menace de vendre la propriété à quelqu'un d'autre (étant donné que le terrain et l'immeuble à prix de la valeur avec la surchauffe) et demande aux acheteurs de s'engager par écrit pour refinancer leur maison dans 1 an. Il réclame 30 000$.
12. Sandra futée, réussis à trouver une entente pour reloger sa famille dans la maison modèle de Sorel-Tracy bien malgré le refus catégorique du promoteur.
13. À bout de souffle, ils emménagent finalement dans la maison modèle fin juin 2021. Ils allaient devenir mes faux voisins!
L'histoire peut vous paraitre longue, mais sachez que je minimise le tout autant que possible. L'agilité avec laquelle le promoteur a su gérer et manipuler cette famille est ahurissante.
PIRE ENCORE, ILS NE SONT PAS LES SEULES VICTIMES.
Aujourd'hui, la petite famille habite toujours la maison modèle. Ils sont maintenant en poursuite pour passation de titre, car évidemment le promoteur se sent lésé. Soit dit en passant, le promoteur a perdu sa garantie de construction GCR depuis octobre 2021. La maison, elle, est habitable depuis octobre 2021, Les Lagacé refusent depuis toute négociation pour que notre famille puisse lacheter ,mais la laisse à l'abandon. Elle a passé l'hiver sans revêtement extérieur.
Aux dernières nouvelles, un des créanciers du promoteur Le groupe Custeau va prendre possession de la propriété. La poursuite en passation de titre ne vaut plus rien. Notre famille a déjà versé plus de 30 000$ en frais d'avocat.
Les Lagacé refusent de leur vendre la maison et préfère la laisser se faire saisir !!!
Le créancier demande que la totalité du pret contracte par Les Lagacé soit payé en une fois si ils veulent obtenir leur maison et doivent s'occuper eu même de la saisie et des frais juridiques associés . Sinon il vendra la maison au plus offrant.
Mes faux voisins sont des gens en or. Ils sont résilients. À les voir, on imaginerait jamais la nature du cauchemar qu'ils vivent depuis 2 ans. Tous les jours, ils conduisent les enfants de Sorel à Varennes pour l'école. Ils tentent tant bien que mal de donner un environnement normal à leurs enfants. Imaginez seulement la détresse des parents.
Afin de payer les frais pour la saisie du créancier, il manque 30 000$. Ils se battent, ils ne baissent pas les bras, ils y rêvent encore... Sandra prends maintenant des anti-dépresseurs, on lui a volé tous les beaux moments de sa grossesse. Jaimy et Sam souffre énormément du manque de stabilité.
Aidez-moi à les aider! Tant qu'il y a de l'amour, il y a de l'espoir, et de l'amour dans cette famille il y en a. Maintenant, il nous faut de l'espoir.

A new resident of Sorel-Tracy since last summer, I met those I thought were my neighbours. It was Sam, a 4-year-old boy, who came knocking on my door in the middle of August 2021. My husband opened the door, Sam said to him "It won't be long, keep the door open, my parents don't mind. are coming".
This is how we, my husband and I, got to know this superb family: Evanir (36 years old), Sandra (30 years old), Jaimy (10 years old), Sam (4 years old), the youngest Séréna (1 year old now) and the cat Milo.
Unfortunately their story leads me to do a fundraising campaign, because soon, they will be in spite of themselves, once again, on the street.
In 2020, they owned a new house in Sainte-Sophie.
Wanting to be closer to Evanir's work, they chose to settle in Sorel-Tracy. A promoter will be the beginning of the end for them. Following the signing of a preliminary contract and a deposit of $28,000, the dice are cast. For them it was the beginning of the construction of their dream house, without suspecting that the dream was going to turn into a nightmare.
Following the choice of the developer (JAC Construction/Maison Lagacé) and the signing of the contract in June 2020, the delivery of the property being guaranteed for October 2020, the nightmare begins:
1. Being proactive, having confidence, our beautiful family is selling their Sainte-Sophie property in July 2020.
2. In the meantime, they are renting an RB&B until October 2020, the furniture in warehouse. The promoter having promised to relocate them to their model home in Sorel-Tracy at the end of the RB&B contract, if necessary.
3. The end of the RB&B rental is coming, the model house is not available because it is occupied by another family. Our family finds themselves on the street for the first time in November 2020. Luckily, they manage to extend the RB&B until December 2020.
4. Work begins more than 3 months late, December 1, 2020! Delivery now guaranteed for March 2021.
5. Note, Sandra is pregnant, she is in her 6th month of pregnancy. Imagine stress and anxiety.
6. The developer sublets them, supposedly until September 2021, the accommodation of a client of theirs, which is supposed to be furnished. Our family arrives, the accommodation is empty of furniture! So they go get their own furniture at the warehouse, just to have beds to sleep on! Subsequently, our family hires emergency movers for the rest of the furniture.
7. On February 20, 2021, Séréna was born. A month in advance.
8. Obviously delivery postponed for April, May, June 2021. In the meantime, the developer decides to terminate the lease on July 1, guaranteeing delivery on June 1, 2021.
9. June 1, 2021, the developer announces that the property will not be delivered on time, maybe July 1. Ben damn!
10. Once again, our family is homeless. Think about it, a newborn, 2 young children. They are on their third move in less than a year. Luckily, there is love.
11. On June 21, 2021, the promoter summons them to his office to extract additional money from them. What do you want? The Covid has a broad back. He threatens to sell the property to someone else (given that the land and the building are overpriced with the overheating) and asks the buyers to commit in writing to refinance their house in 1 year. He is claiming $30,000.
12. Clever Sandra, managed to find an agreement to relocate her family to the model house in Sorel-Tracy, despite the promoter's categorical refusal.
13. Out of breath, they finally move into the model home at the end of June 2021. They were going to be my fake neighbors!
The story may seem long to you, but know that I minimize everything as much as possible. The agility with which the promoter was able to manage and manipulate this family is astonishing.
WORSE, THEY ARE NOT THE ONLY VICTIMS.
Today, the little family still lives in the model house. They are now in pursuit for transfer of title, because obviously the promoter feels aggrieved. By the way, the developer has lost his GCR construction guarantee since October 2021. The house has been habitable since October 2021, The Lagacé have since refused any negotiations so that our family can buy it, but leaves it abandoned. She spent the winter without outer covering.
At the latest news, one of the creditors of the promoter Le groupe Custeau will take possession of the property. The lawsuit in passing of title is worth nothing. Our family has already paid over $30,000 in legal fees.
The creditor asks that the entire loan contracted by Les Lagacé be paid at once if they want to get their house and have to deal with the seizure and the associated legal fees. Otherwise he will sell the house to the highest bidder.
My fake neighbors are golden people. They are resilient. To see them, you would never imagine the nature of the nightmare they have been living for 2 years. Every day, they drive the children from Sorel to Varennes for school. They try somehow to give their children a normal environment. Just imagine the distress of the parents.
