Save Vape Flavours for Adults in New Brunswick.

New Brunswick’s Bill 63 has received Royal Assent, prohibiting the sale of flavours except for tobacco.

We know based on history that former smokers will relapse back to smoking and many current smokers will be prevented from making the switch to vaping. One just needs to look at Nova Scotia where cigarette sales increased after a similar ban last year .

Vaping has conclusively shown to be far less harmful than smoking and flavours are the key to its success.

There is no credible evidence to suggest that banning flavours will prevent youth vaping, but may have the opposite affect based on the Yale School of Public Health Study that was published in JAMA Pediatrics  on May 24, 2021  which tracked an increase in youth smoking rates since the flavour ban  on vape products in San Francisco.

Adult smokers have the constitutional right to access effective harm reduction products and removing flavours violates this right. Flavour bans make vaping a less attractive quit aid and have shown to undo the smoking prevalence reduction progress Canada has achieved. By allowing only tobacco flavours in the market, this would only normalize the use of tobacco products since no other flavour options are available.

This constitutional violation is supported by the Canadian Constitution Foundation , which states, “…flavor restrictions, have the potential to make [vapes] less attractive or effective as quit-aids—and are considered from the standpoint of potential interference with the right not to be deprived of life, liberty, and the security of the person protected" 

New Brunswickers, Charles Byram, has made the decision to stand up to the New Brunswick government and file a charter challenge and has committed to working with renounced Constitutional Lawyers from the firm Cambridge LLP .

Here is the thing - Charter challenges are expensive, and we want to help Charles. The bare minimum cost is at $150,000. 

That is why The Canadian Vaping Association  (CVA) has launched this fundraiser in support of Plaintiff Charles Byram's efforts to hold the government accountable for willfully violating the constitutional rights of New Brunswickers. 

The donated funds collected on behalf of Charles Byram will be used to retain Cambridge LLP . 

Below is the breakdown of what the funds would be used. It would include, plus additional administrative support costs:


·        Injunction preparation and filing

·        Section 7 Charter Challenge

·        Subject matter expert requirement

·        Studies

·        Researcher support on discovery and documentation

It's imperative that as Canadians, we hold government accountable to our charter of rights and freedoms, and that when they cross the line, we use our court systems to uphold our rights. 

New Brunswick vapers and smokers need your support to hold the government accountable. If you vape, know someone that vapes, support harm reduction or simply believe that government are not above the Canadian Charter of Rights and Freedoms, please make a donation to this fundraiser. Every dollar will go to support this legal battle to help defend Canadians right to access harm reduction.

This gofundme was setup by The Canadian Vaping Association. www.thecva.org . The Canadian Vaping Association is a registered national, not-for-profit organization, established as the voice for the burgeoning Canadian vaping industry. Founded in 2014, the CVA represents over 200 retail and online vaping businesses in Canada, not including tobacco companies or affiliates. The association is the primary liaison with the federal and provincial governments on all legislative and regulatory issues related to the industry. The primary goal of CVA is to ensure that government regulation is reasonable and practical, through the strategy of professional proactive communication and education supplied bilingually to health officers, media, and elected officials.

The donation will be used to support our membership in New Brunswick to pay for the upfront cost for the Charter Challenge. All legal funds will be directed to the beneficiary - The Canadian Vaping Association. The  funds will be deposited to the CVA legal fund account and disburse to the lawyers to support the plaintiffs legal challenge.
