From Dream Home to Legal Nightmare – Help Us Fight Back!

Imagine moving across the country during COVID, continuing a 10-year firefighting career for the City of Memphis, and building your dream home for your family of 8—only to have the builder sue you over the very problems they created.

That’s our reality. And now, we’re asking for your help because we were notified this week that we have until March 24 2025 to pay TEN THOUSAND dollars (click underlined for proof) for arbitration that is scheduled for April 2026. I am already working three—sometimes four—jobs, clocking 72 to 86 hours a week, just to keep up with this legal battle. Joe took on a second job last year, working on his so-called “days off” after grueling 24-hour shifts—often running on just a few hours of sleep, if any. We are already pushing beyond what is humanly possible to fight this, but we can’t do it alone.

If we win this case, we promise to refund every single donation. Those who know us know that we keep our word.

Our Story
In 2020, we contracted with Regency Homebuilders, LLC to build our dream home for us and our six children.
From the beginning, the building process was riddled with errors, delays, and missing upgrades—things we had already paid for. By May 2021, we still had no closing date (initial projected completion date was November 2020) and uncovered even more issues the week of May 24, 2021. Concerned, we asked Regency to mutually cancel the contract and refund our ~$160,000 in upgrades. (I am a Veteran and on a VA Loan Regency required 100% of upgrades to be paid in cash).

That’s when things took a dark turn.
Instead of discussing a resolution, Regency threatened us with breach of contract unless we closed immediately—on a home that wasn’t even finished. If we refused, we would lose all ~$160,000 and could be sued for the difference if they sold it for less than our contract price of $680,000.
Faced with financial ruin, we had no choice but to close.

A House Falling Apart

Day 3: Our dishwasher flooded the kitchen—a known issue Regency lied to us about. We had no water, electricity, or gas in our kitchen for over 30 days during the 3 month repair process. During this time we also had a plethora of other issues & warranty claims.
Month 7: Every toilet in the house backed up. The cause? A major plumbing defect hidden under a load-bearing wall with no gradebeam or footing.
Our roof leaks, our windows leak, our back door leaks, and the backyard floods with feet of standing water that often lasts for weeks after every rain.
Our patio is cracked in half with differential, our electrical system has had numerous issues, our HVAC system does not head our home evenly and now—
Our foundation is failing.
The foundation is so compromised that we cannot currently place flooring on the concrete slab because it is too wet (click for video) - even after weeks of dehumidifiers, fans and trying to reacclimate it.

Why We Need Your Help
Instead of honoring their warranty, Regency sued me (click to see regency’s lawsuit) personally for
1. Defamation – for telling the truth in a parenting group when I was searching for a painter, and sharing photos and videos of our kitchen and concrete slab repair. Their frivolous lawsuit is a violation of the Tennessee Public Participation Act (TPPA)
2. Violating a non-disparagement clause – which is illegal under federal consumer protection laws. Consumers have a legal right to share their honest experiences.
3. Not following their warranty process – because I reached out to their subcontractors as they instructed me to do (in writing) and I told their subcontractors what to do when they arrived for warranty work.

We have spent over $100,000 fighting their frivolous lawsuit, and defending ours regarding the home defects, and close to 300 of my personal hours since 2022 as we work feverishly on this case, all the while living in a house that is literally falling apart and stealing time from our kids and eachother.

Now, we need to raise $10,000 in the next 30 days to proceed with arbitration in April 2026. We are also raising $5,000 in funds for an engineer and leak detection company.

We never wanted to ask for help, but we can’t fight this alone. Every dollar will help us stand up to a powerful multimillion dollar homebuilder who thinks they can bully homeowners into silence.
