Oklahoma Law’s on Cap for Suing public School need to Change!!
On May 3, 2018, I sent my son to school with the understanding that he would be supervised. He would be safe. It was part of their mission statement, after all. While participating in his shop class, he was instructed by his teacher to use an industrial strength table saw that was not utilizing the required safety features, specifically removing the blade guard just before use. Predictably, the worst thing possible happens and his left hand is pulled through the spinning blade. The teacher cleaned his hand, then took him to the office where they left him for 14 minutes before calling an ambulance. Emergency procedures and surgeries were not able to save Isaiah’s fingers and have left him with a complete lack of strength or ability to make a fist. Obviously, this is going to affect him for the rest of his life. The school district originally denied they were at fault but at the last second, admitted that they were not going to contest liability at trial. They offered to confess judgement in the amount of $125,000 which was begrudgingly accepted because of a little-known law that caps the amount of that government entities are responsible for. This leaves Isaiah in a situation where he is stuck with the estimated $2,776,000 dollars in future medical and earning potential. We are sharing our story in hopes that it catches the legislatures attention and they raise the amounts statutorily available to so that the next child seriously injured and disabled by a school will not find themselves in the same whole as Isaiah. Any help with Isaiah’s coming medical and living expenses would be forever appreciated while we continue the fight to raise the Government Tort limits.
