Brothers Robbed and Shot at Job Site. Workers Comp claim denied. Need Help for Medical & Expenses
NASHVILLE, Tenn. Thursday, February 26, 2015 – It was a normal day at work for the crew of 4 construction workers (3 of them of which are brothers) at a job site when around 11:00 am, two gunmen entered the construction from behind, in an armed robbery, shooting two of the brothers.
Saul Belmontes, 24, and Omar Belmontes 23, were working on the roof, while Jesus, 26, was inside the residence and the 4th worker was in the front of the house, cutting wood for framing.
When Saul saw that Jesus was being held at gunpoint and searched, he rushed down from the rooftop, followed by Omar. By the time he made it downstairs, his brother Jesus had being shot and was laying in the ground.
Saul was hugging Jesus when he heard another shot behind him. The second shooter had shot his other brother, Omar, who also rushed downstairs just behind Saul.
It’s very hard to imagine the gruesome scene and the terrifying moments that these workers must have endured after the episode, who were doing nothing wrong but just trying to make an honest living.
It is very well known that construction workers, specially roofers, are at high risk of suffering on-the-job injuries because of accidents, but getting robbed and shot while working?
As incredible as it may seem, that is exactly what happened to these workers. Unfortunately, there is an alarming increase in this type of crime in the area, which seems to be targeting Hispanics in Nashville because of their ethnicity. For the Latino community and some researchers, the trend is very clear: It is a very well known fact that mostly, Hispanics don’t use banks and largely they don’t report crimes to the police because they are scared, so they are easy prey for criminals. Just check the stats.
And according to the Metro Police, just in the month of February, 8 armed robberies were reported at job sites, 4 of them confirmed with Latino workers. Actually, a different crew from the same company was also robbed at gun point a month before this incident, at a nearby construction job site, too, only fortunately, nobody got shot there.
As a result of this horrible, non-sense crime, Omar’s injuries resulted in leaving him not only paralyzed from the neck down, but actually, quadriplegic. Basically, the only undamaged part of his body is his brains.
That means that Omar has to be in life-support for the rest of his life.
Not only he can’t move any part of his body, but Omar can’t breathe by himself, so he totally depends on the ventilator to help him breathe.
Omar will never be able to eat regular food, because of the choking hazard. He will have to be fed thru a tube inserted in his nose.
According to the doctors treating him at Vanderbilt Hospital, Omar needs a surgery to stabilize his neck, but is not doable yet due to his current medical condition.
Also, he is at very high risk of infections that always occur in patients on this condition, which could not only make his life even more difficult, but also significantly shorten it.
As per the case manager’s statements, when Omar is released from the Hospital, he will need to go to a second facility to teach him to communicate.
Unfortunately, he will never be able to go back home, since according to his doctors, a person in his condition can only be released to a third medical place, where he will have to be taken care of and watched 24 hours a day, due to the machines that are supporting his life.
Unfortunately and because the company where Omar and his brothers were working is a local, very small family business, they did not have any benefits other than workers comp insurance.
Adding insult to injury and to make things worse, the hospital informed that the claim was denied by the insurance carrier due to the fact that Jesus’ and Omar’s injuries were not a result of an accident on the job nor negligence, but a crime.
As of March 10, Omar’s hospital bill, was nearly $200,000 dollars and the next facility where he was supposed to be released to, rejected him because there's no financial agreement.
The costs of treating and living with quadriplegia are high. The Christopher and Dana Reeve Foundation estimates that in the first year alone, tetraplegia costs run $228,566 – $775,567 or more. In each subsequent year, tetraplegia costs are $681,843 – $3 million for a 25 year old. Saul is only 23 now.

By the way, the perpetrators are at large and the investigation into this robbery and shooting is ongoing. Metro’s police gang unit is also investigating.
The robbers are described as African-American males in their late teens to early 20s with dreadlocks. One was wearing a black hooded sweatshirt. The other wore a gray hooded sweatshirt with a red toboggan. They fled from the construction site on foot after the shooting.

Please help the Belmontes Family and specially, Omar with his medical and expense fund. The funds raised will be deposited directly to Saul Belmontes’ account for Omar’s medical fund, to help cover the costs for hospitalization and other therapies which will be huge out-of-pocket expenses.
And while they’re looking for legal help, it may be years before Jesus’ and Omar’s medical expenses are covered, if ever, since according to the insurance carrier, even though the injuries happened at the job site, they were not caused by an accident or negligence, and therefore, not such claim can be filed or approved.
The immediate costs to help the family and Omar recover, however, cannot be deferred in the hopes of any legal settlement.

Saúl Belmontes, de 24 años, y Omar Belmontes de 23, estaban trabajando en el techo, mientras que Jesús, de 26 años, estaba dentro de la residencia y el cuarto trabajador estaba en la parte delantera de la casa, cortando madera para enmarcar.
Cuando Saúl vio que a Jesús le apuntaban con una pistola mientras lo bolseaban buscando su cartera, bajó corriendo del techo para auxiliar a su hermano, seguido de Omar. En el momento de llegar a la planta baja, su hermano Jesús recibía un disparo y estaba tirado en el suelo.
Saúl estaba abrazando a Jesús cuando escuchó otro disparo a sus espaldas. El segundo tirador había disparado contra su otro hermano, Omar, quien también había corrido a la planta baja justo detrás de Saúl.
Es muy difícil imaginar la horrible escena y los momentos terribles que estos trabajadores deben haber sufrido después del episodio, sólo estaban trabajando, ganándose la vida honradamente.
Es muy bien sabido que los trabajadores de la construcción, especialmente los que trabajan reparando techos, están en alto riesgo de sufrir lesiones en el trabajo a causa de accidentes, pero sufrir robos y disparos mientras trabajan?
Por increíble que parezca, eso es exactamente lo que le pasó a estos trabajadores. Desafortunadamente, hay un aumento alarmante en este tipo de delitos en la zona, que parece estar dirigida a los hispanos en Nashville por su origen étnico. Para la comunidad latina y algunos investigadores, la tendencia es muy clara: Es un hecho muy conocido que en su mayoría, los hispanos no usan los bancos y en gran medida no reportan crímenes a la policía porque tienen miedo, por lo que son fáciles presa para los delincuentes. Sólo basta con checar las estadísticas.
Y de acuerdo con la Policía Metropolitana del Condado de Davidson, sólo en el mes de febrero, se registraron 8 robos a mano armada en los sitios de trabajo, 4 de ellos confirmados eran de trabajadores latinos. En realidad, un equipo diferente de la misma empresa también fue robado a punta de pistola un mes antes de este incidente, también en un sitio de trabajo de construcción a unas calles de ahí, sólo que por suerte, nadie resultó herido en el primer asalto.
Como resultado de este horrible crimen sin sentido, las lesiones de Omar resultaron al dejarlo no sólo paralizado del cuello para abajo, sino completamente paralizado, es decir, quadraplégico. Prácticamente, la única parte no dañada de su cuerpo es su cerebro.
Eso significa que Omar tiene que depender de cuidado médico y nunca podrá valerse por sí mismo por el resto de su vida.
No sólo él no puede mover ninguna parte de su cuerpo, Omar tampoco puede respirar por sí mismo, por lo que depende totalmente de la máquina que le ayuda a respirar para sobrevivir.
Omar nunca será capaz de comer ninguna comida regular, debido al riesgo de asfixia. Él tendrá que ser alimentado a través de un tubo insertado en la nariz.
Según los médicos que lo tratan en Vanderbilt hospital, Omar necesita una cirugía para estabilizar el cuello, pero no es factible ahora, debido a su estado de salud actual.
También, él está en alto riesgo de sufrir infecciones que siempre ocurren en pacientes con esta condición, que no sólo podrían hacer su vida aún más difícil, pero también reducirla significativamente.

Desafortunadamente y debido a que la empresa en la que Omar y sus hermanos estaban trabajando es una pequeña empresa lfamiliar local,ellos no tenían ningún beneficio mas que el seguro de compensación al trabajador.
Para colmo de males, y para empeorar las cosas, el hospital informó que la reclamación fue negada por la compañía de seguros debido al hecho de que las lesiones de Omar y Jesús no fueron resultado de un accidente en el trabajo, sino un crimen.
Solamente hasta el 10 de marzo, la cuenta del hospital de Omar, era casi $ 200,000 dólares, sin contar la cirugía pendiente para estabilizar su cuello y su traslado a una institución para enseñarle a comunicarse, de la cual ha sido rechazado por que no hay acuerdo financiero para cubrir el costo.
Los costos del tratamiento medico y vivir con quadraplegia, son muy altos. La Fundacion de Christopher and Dana Reeve Foundation estima que solo en el primer año, los costos pueden ser desde $740,000 hasta $1,024,000 o mas. Y cada año subsecuente, los costos pueden ir desde $109,000 hasta $172,000, resultando en gastos de por vida estimados desde $2.5 million hasta $4.53 millones o mas.
Por cierto, los autores del crimen siguen a la fuga y la investigación de este robo y tiroteo está en curso. La Unidad de Pandillas de la policía de Metro Nashville también está investigando.
Los asaltantes son descritos como hombres afroamericanos de aproximadamente 20 años o menos con trenzas en el cabello. Uno de ellos llevaba una sudadera con capucha negra. El otro llevaba una sudadera con capucha gris con un tobogán rojo. Huyeron de la obra de construcción a pie después del tiroteo.
Cualquiera que conozca la identidad de los dos sospechosos podría recibir una recompensa de hasta $1,000 por datos que lleven a la ubicación y captura de los sospechos, llamando a la policía de Metro o Crime Stoppers al 615-74-CRIME (615-742-7463).
