The National Second Amendment Foundation, headed by the respectable Alan Gottlieb has jumped in on this case and will be helping push it forward with the great Evan Nappen and hopefully eventually Alan Gura.
This is wonderful news again for NJ, the courts have denied hearing Drake and Pantano but that does not mean we accept the NO and sit back down. 

My denial of a permit at the Superior Court level, and the outrageous decision by Judge Conforti allows us to open the gates and move this up.

In New Jersey, this restriction on the Right to Bear Arms, carry permit "may issue" and Justifiable need law is so restrictive that it pretty guarantees that you will be denied, unless you are Security Officer applying for a carry permit that is required for your employment and you are endorsed by the employer or A retired police officer that meets the terms they set for it. The battle to change this "may issue / Justifiable need" clause has been way overdue. The "MAY ISSUE" Justifiable Need clause is so vague that it needs to be challenged and changed to "WORDING THAT WILL PROTECT YOU, THE LAW ABIDING PERSON FOR DEFENSE AGAINST A CRIME TOWARDS YOU", NOT LEAVE IT UP TO A BUREAUCRAT THAT HE/SHE ALONE DECIDES WHO HAS THE RIGHT TO DEFEND THEM SELVES WITH A PISTOL. For this reason so many NJ citizen's do not apply for a CCW permit out of fear of being denied, and fear that because when you are denied it may also affect future Gun purchases because now you have this unjust denial on your record.

How many NJ citizens have a credible need to carry but do not apply for this fear of denial alone?

Justifiable need, is codified in NJ Administrative code as follows: "The urgent necessity for self-protection, as evidence of specific threats or previous attacks which demonstrate a special danger to the applicant's life that cannot be avoided by means other than by issuance of a permit to carry a handgun".

But even with this wording, it is not followed and you still are at the mercy of one individual that make a decision if you are approved or not and the OVERWHELMINGLY MAJORITY of applicants get denied.

like many other great Americans, I recently applied for a CCW permit due to a credible threat against my life by a career criminal, but I was denied because it was not justifiable (read my story below). I am appealing my denial and we are working on possibly being a backup case to the current pending Pantana and Drake NJ cases. Drake is currently waiting on SCOTUS certification and Pantano is currently waiting on NJ State hearing. I have hired the law firm of Evan Nappen Esq. for my case (confirmed on 11/6/2013) to lead this appeal and to proceed forward to the next level if possible with me. I want to help bring the attention of these restrictions of our rights in NJ to the attention of the Nation. But it will be expensive and I need your help leading this battle forward. I want to help establish a fund that will help this case as well as future cases on this issue going forward.

It will be costly, but our liberties and rights to self-protection outside of our homes SHOULD NOT have a price tag. For to many years the great citizens of NJ have either turned their cheek the other way towards violence, accepted the "NO" from the Local Police Chief or Courts, lost motivation or just flat out did not try because they know the fight can be a hard one. The harder the fight is, the more I move forward and want to fight to change this for us ALL.

But I cannot fight this battle alone financially and without the support of Great Americans like you. I need financial help for the retainer, I need people like me to come forward and join the cause. Let's put our money and positive attitude in fighting for a cause well worth fighting for. Not just for you and I but for our children's future and thousands of Great Americans that wish they only had a chance at winning this right that so many enjoy outside of New Jersey have and enjoy.

My story:
Why am I doing this? I am a former long term EMT that worked in one of NJ's most violent Cities (Newark) for almost 25 years, I am a proud father of two very beautiful little girls that make me cry with happiness every night when I come home, I know what I mean to these two young beautiful girls (including my lovely wife). I have seen thousands of innocent victims of robberies, carjacking's, stabbings and shootings. Many of them were innocent children and women. How many of these victims had credible threats against them but had no protection at home, on the streets or from a loved one? After I retired in 2011 I started my own business dealing with Property Management mostly in the Newark and Irvington areas. My new line of work requires me to deal with Properties located in some very tough areas and also with some very tough tenants (Gang members, or just bad people looking for an opportunity to do someone harm). I have to deal with large amounts of cash for my customers that I serve (rent collections at times can be several thousand dollars at a given time). Recently in June of this year (2013) I was verbally assaulted and my life was threatened 14 different ways by a Tenant that promised to kill me, have me killed by his "street boys" and have me robbed of the rent , it will be made to look random after they toss my body on a dead end street all because he did not want to pay the rent.

I advised this tenant that I was making a terroristic threat report and his response to me was " go ahead, call the cops, I'll shoot them also". A Report was filed, an interview was done with the Detective and the complaint signed against the subject. I thought, okay they are going to get this guy off the streets because I agreed to pursue this complaint forward.

Six months later, no arrest, no follow up and no interest in getting this guy who not only threatened me but also said he would kill cops if they showed up to the door! I called the Detective and asked for a follow up, his response to me was: Why don't you go to this guy's house, see if he is home, have him come out and then call us so we can go pick him up, and when you call communications, make sure you give them your CC# so you can be put on the priority list because we don't know where this guy is! (If I can reach my phone as I lay shot on the ground?). My response to the Detective was: Are you joking around? Who carries the gun and works in large L.E.O teams? You guys! So why do I have to go fish this guy out? He told me it was because they did not know where he is! Great, now I have to constantly look over my shoulders because this guy is out on the streets hiding from Justice?

With this said, I applied for a NJ CCW permit and pleaded my case on paper, provided all documents needed including my weapons training and carry insurance that I purchased for my out of state CCW permit. I have the training, I have the good clean record and all background checks clean. Even though I expected a denial, I still thought that I had a valid reason since the threat was credible and I meet the requirements on the "BOOKS", The death promise alone towards me, the promise to rob me of the cash and because I carry large amounts of cash on me for my job in dangerous areas, I have various training on weapons use. Well, I was denied anyway.

How many of us in NJ have been denied but have a good reason to carry? How many of us in NJ want to apply but do not because we know the end result? How many of us believe that we cannot win over the NJ Courts and Politics? Did you think Heller in D.C thought that or what about McDonald in Illinois? Where did that get them? It got us all in the Nation positive gun rights re-affirmed (except in NJ).

It is not all about me or an individual, let it be about us, about our rights and liberties for all Great American's in NJ and this Nation now and in the future. I am motivated, I am willing and I want this battle for us all to move forward even if it ends up in the U.S Supreme courts (If allowed to be heard). I would love to see many more join this worthy fight, I want to join those fighting and have you join me. WE CAN WIN THIS, we are tough people with strong attitudes in NJ. Let's show the nation and let's join the other great States that trust and allow the law abiding citizens the right to carry outside of their home.
