Jay Lynn passed away suddenly in Kingston in September of 2017. She left behind her fiancee, Scott, and his son, Bryce, along with many friends. At the young age of 26, Jay Lynn did not have a will - however she did express her wishes to Scott that when the time came, she wished to be cremated and to remain in Ontario with her new family.
Due to the fact that Jay Lynn passed in September of 2017, roughly 8 months before they planned to get married, Scott was left with no legal right to Jay Lynn's remains or final wishes. Instead, the right belonged to Jay Lynn's biological mother, whose care she had been removed from as a child. It was at this time that Scott had to hire legal assistance in gaining the right to executor of an individual without a will.
Jay Lynn's biological family prolonged the process by ignoring attempts of contact through the entire court process thus requiring Scott to repeatedly take further legal action. Scott was deemed the court appointed executor of an individual without a will nearly 6 months after Jay Lynn's date of death. Due to the extended legal process, Jay Lynn remained in a morgue for the duration of the 6 months leaving her closest friends and loved ones without closure.
As a result of 6 months of continuous legal action and holding a funeral, a hefty bill of over $14,000 has accrued in addition to the funds that Scott, with the help of his family, already paid. Scott is responsible for this bill. As a grieving single dad, we ask that anyone who is willing and able to contribute to this cause do so in order to lessen the financial burden that this holds. Every little bit helps.
Let this be a hard lesson learned, no matter your age, please think about drafting a will - it could save your loved ones lots of hurt and allow for proper grieving to take place. Without a will, Canadian legislation is a very long process.
