Kansas is trampling on the rights of childless couples!

One man (William Marotta) who tried to help is paying the price! Will Marotta responded to a plea for a donor from a Topeka couple. After hearing their story, he agreed to help.

According to the laws of the state of Kansas and many others, “You can be forced,” into a situation that dictates how you may conceive a child! Many states allow “Home Insemination.” Here’s the rub! If the parent, or parents should ever apply for any sort of state aid and they did not use a doctor’s office to perform the artificial insemination, any “Good Samaritan” donor can be slapped with a child support suit by the state.

This egregious act occurs because, according to the judge and lawyers of the state of Kansas, “any” attempt at home insemination is illegal. To do so can result in prosecution of the “known” donor for child support.

Under the judges interpretation of the law, “Home Insemination is Illegal in Kansas.”

This violates the rights of couples wanting nothing but to experience the joy of childbirth. It steals intimacy and bonding, and robs couples of their desire and need for sharing the experience.  You may not have a child by any method not “condoned” by the State of Kansas.

Artificial insemination is not difficult and couples can do it at home. Some decide to with help from Midwives, health aides, or with a little instruction by their family medical practitioner. This is not the first foray into “State controlled birth,” by Kansas.  Did we mention that it costs several Thousands of dollars for a procedure that takes only a few minutes?

Will Marotta is being sued for child support because he donated sperm to a childless couple.  This suit is based on the state judge and lawyers' interpretation of a Kansas statute. They insist that for a man to be considered a Donor, a physician must perform the insemination. 

Alabama, Delaware, New Mexico, North Dakota, Oklahoma, Texas, Utah, Washington and Wyoming, all have adopted new laws that allow for artificial insemination at home. These states honor the wishes of their citizens in these matters.

The state of Kansas is also not honoring the wishes of the same-sex couple to whom Will donated.  The partner of the biological mother has been the co-parent to the child and she intends to continue.  But the state judge refuses to acknowledge her role as a parent, dictating that Will should be declared the child's father.

We, the friends of Will Marotta, are working to help a man who only meant to help. Will and his wife also have been ardent supporters of foster parenting, having done so for the last seven years.

Please support our campaign!  Will fights this unfair interpretation of the law and protects your own rights as well. He has spent tens of thousands and will continue to fight the State of Kansas.
