Active Coast Guard Unjustly Charged

Young Military couple need help with legal expenses to fight unfounded, and unjustified charges made against my husband Kenny Molinary, who has been in the U.S. coast Guard since July 2007.

Here is the problem – first, let me say that Kenny has NEVER been in any trouble before until this…

A U-Haul company in Big Pine Key, Florida says my husband who is an Active Duty Member of the U.S. Coast Guard stole a large cab-over rental truck! Even though the truck was returned and the we paid them $840.45 on our debit card.

Like many other people, we chose to use a rented truck from U-Hall to perform a move ourselves. My husband, Kenny Molinary, went to the local neighborhood U-Haul dealer and rented a truck for the local move. Kenny gave the U-Haul dealer a debit card which was put on file and he picked up the truck. The reservation was local; that is, picking up and returning to the same location.

We began the process of moving, taking our time due to our conflicting work schedules. We were having to move because we were being forced to move out of the house we rented in Big Pine Key due to the fact the bank foreclosed on our landlord who didn't tell us…and the bank was taking possession.

We had no place to move to and we were frantically searching for a new place to rent. The bank gave us a deadline to move out. It was hard to find another rental due to it being vacation season in the Keys. After looking everywhere - we finally found a new house to rent that would allow us to keep our pets.

So, fast-forward to after our move was completed. My husband drove the truck to the rental center, pulled into the parking lot, and stepped out. The office was closed, and no employees were around. My husband along with a friend who was helping us move decided to put the keys in the after-hours drop box and leave the truck in the parking lot. My husband then headed home.

So, the truck was returned back in February, and life went on at our new house – my husband went to work on the Coast Guard base in Key West and I went to my job as a Veterinary Tech. Assistant. This month we received notice that we were being transferred to the Coast Guard station in St. Petersburg, Florida. We were supposed to be going to St. Pete and my husband was supposed to be going on to Virginia for additional training related to the Coast Guard cutter he was being assigned to. The Coast Guard said they couldn't pay to have us moved to St. Pete for because they couldn't get a company to move us due to availability. We were told that we needed to move ourselves and would be reimbursed.

Because of my husbands training his temporary orders were given to us late and due to time constraints we placed our personal stuff in storage not far from where we lived. My husband was supposed to be heading to Virginia for two and half months training. The Coast Guard issued him a government credit card to travel purposes related to his training. The card was not activated by the time we decided to visit my parents in South Carolina and my husband would drop me off and I would stay there with them along with our pets.

Our plan was after his training was done my husband would drive back to pick me up and off to St. Pete we would go to live and work…and arrange for our belongings to be shipped to us.

Upon arriving at my parents home on a Monday, we said hello and I we unloaded our things and got the pets situated. My husband called his command to check on why the travel card wasn't activated for his trip to Virginia. He received no reply other than it was delayed. He called the Coast Guard several more times and we felt he was getting the run around for some reason. Then his command called and said he needed to report to the Coast Guard base in Jacksonville Florida on Wednesday.

So, on Wednesday my husband got in his uniform and drove from South Carolina to the Coast Guard base in Jacksonville. Shortly after he arrived his car keys were taken and he was interviewed and arrested on an out of County warrant. My husband charges were
GRAND THEFT OF MOTOR VEHICLE, and FAIL TO REDELIVER HIRED LEASED PROPERTY OF $300 OR OVER.

After my husband was booked he was told that he had a court date at 1:00 pm on Friday. We hired an attorney and sent them evidence from our bank statements that showed we paid money to U-Haul for the truck. As I mentioned earlier my husband returned the truck. My husband went to court and the judge upheld the bond of $7,500. The judge wouldn't change anything because the case jurisdiction was in Monroe County Florida (Key West), and he would have to go through the process there.

My husband bonded out of jail Thursday, and I was referred to an attorney in Key West. I talked to the attorney who said from what he heard and read this case is sketchy at best. He wants to talk with my husband before he gives us an estimate for his services. The attorney is hoping to get the case dismissed before my husbands next court date which hasn't been set at the time of this posting.

My husband was given a very short leave to come back to South Carolina where my parents live. Kenny was told that he has to report to the U.S. Coast Guard base in Key West, Florida by midnight Saturday night. My husband is a nervous wreck and doesn't know what to expect when he get back to the base. We did not want him driving because he has not had much sleep since the whole fiasco began. So, he is taking a plane flight to Key West. It is costing us money that we don't want to spend but it is safer for my husband not to worry about driving from South Carolina in one day. I will post an update as soon as we learn more.

My reason for this requesting help is simple. We are a young couple and don't have the money to due this by ourselves. We have tapped out both our families ability to financially help us even though they are still going to try the best they can. I am a veteran, and my husband is still active duty.

Updates will be forth coming...but we need help!

Suffice it to say that U-Haul won’t be getting any of our business in the future.
