JUSTICE FOR TAMIA ILLEGAL REMOVAL

UPDATE 2: The city solicitor lawyer for DHS asked for a juducial review removal hearing on March 22, 2018. Eventhough they removed her without a court order on December 22, 2017 already. We would present witnesses at that point. 

The Mayor of Philadelphia Jim Kenney has not responded as he promised and did nothing to stop this retaliation by NET CUA and DHS after I filed grievances against them last year.

Of course my posts will be limited to #JusticeforTamia without any pics of her per court order. #64 days until we can argue against this unlawful removal with no visitation. This is what we all must stand against. If they can remove a child where she was safe, happy and loved then it is no telling the lengths they will go to in order to keep our children in the system. I will continue to fight for Tamia and for the people who may be impacted by these unlawful practices.

UPDATE 1:
NET CUA and DHS have provided conflicted reasons why this child was removed from Tamiera prepaying her lease to training that was completed 8 months ago. Please sign this petition since this child should not have been removed from her preadoptive home without a court order or safety issues.

The Director Leticia Lacomba of NET CUA told police officers on 1-5-2018 that child was removed because Tamiera did not complete training for her to have a permanant home as documented by police in a  report. However training has been completed since April of 2017. NET CUA is running out of options and quickly changing their stories week to week on the reason for removal. If the director of NET CUA Leticia Lacomba is willing to lie to the Philadelphia Police Officers on this issue stating training for the removal then it is no telling what NET CUA is willing to do to rip kids from their families. Training completion was already documented in a court hearings when Tamiera was awarded Physical custody. DHS Commissioner Cynthia Figueroa has declined to take actions on the system issues under her watch and emailed Tamiera to simply tell her to have her lawyer contact the city solicitor lawyer Michael Mon. The commissioner was not compassionate to what Tamiera was going through as a mom who had her child removed 3 days before Christmas without a court order for a second time when no safety issues existed. Tamiera has been reporting these issues to the Commissioner since February 6, 2017. 

This is a clear case of retaliation and was intentional to bring suffering and pain to a family who have bonded since birth for 2 years. Tamiera recently sold her home and can also afford to prepay her bills from her job pay alone. Tamiera manage clinical trials for the past 8 years and has had success as a Entrepreneur and Business Owner.

Tamiera is also certified as a foster care parent and has been certified for the adoption in 2016 and 2017. 

Both NET CUA has completed positive safety check visits for more than 2 years and the child was ordered by Judge Jonathan Irvine to remain in her pre adoptive home with Tamiera.


HER STORY BELOW:

My child Tamia was removed the first time in February 2017 due to a social worker from NET CUA Foster Agency in Philadelphia who was new to the case went to court without notifying me and told the Judge no safety checks were completed since November 2016. It was later confirmed in court that no safety checks were ever missed and via email by Deszeree E. Thomas, J.D.
Vice President of Child Welfare & Juvenile Justice Services for NET.

Email response from grievance filed against NET CUA from Deszeree Thomas in regards to her first removal on February 3, 2017 received in August 2017 below from Deszeree.

"It appears from case record that there were no missed visits. Sherelle Patterson, CUA CM conducted her first visit on 1/30/17 and very well may not have known the last date that a CUA CM conducted a safety visit".

Still during those months of her being away she was put in 2 non family NET CUA Foster homes where she was abused/neglected in both.  The first home they submitted a child abuse investigation for injuries to Tamia's face and the second one they did not. Yes they removed her from a safe, happy, and financially stable home and subjected her to unfamiliar people who caused her injuries and could not afford her standard diapers in a short time.

The child was returned to me after 5 months and I was awarded Temporary Physical Custody July 18, 2017 by Judge Irvine and pending adoption. They never even reported to the court the safety issues she experienced under their watch when they made this error. This is the second time 12-22-2017 they have removed her illegally as recommended by DHS upper management without a court order since we were just one month from going back to court to move forward with the adoption. They have retaliated against me because I have filed grievances against them for their errors. They have illegally removed my child and ignored requests to place her with family. She has a respite provider and a back up guardian who was certified by NET CUA in April 2017 and is also related to Tamia  Yes NET CUA has certified a family member as the respite provider but would rather place the child in a non family related home due to their own bia and predjudice. NET CUA believes they are above the law which states in Pennslyvania they must attempt to contact the child's family. Even a month later NET CUA nor DHS has not attempted to reach out to Tamia's family. This seems to by a systemic issue and needs to be addressed immediately here in Philadelphia.

I pray Tamia is safe and being treated better than the last time when she was removed in error by NET CUA and DHS. We are missing our routine. She does not have her books or favorite tablet. Please pray for me I am suffering emotionally knowing they are treating my child unfairly due to my grievances and have retaliated in such an unlawful way. 

Funds will be used for legal expenses and any excess will be placed in a trust for Tamia as she is suffering the most. If a child can be removed from a home where she was safe and all training and paperwork was completed for her adoption can you imagine what other families in Philadelphia may be faced with.
