NEVADA MEDICAL MARIJUANA PATIENT AND MARINE CORPS VETERAN DEMANDS RIGHTS FOR ALL NEVADA CITIZENS BE REINSTATED.

 

       James Parsons, a Las Vegas resident, an honorably discharged United States Marine Corps veteran, and medical marijuana patient registry card holder today filed suit against the State of Nevada seeking to invalidate two state medical marijuana laws that the State now imposes on medical marijuana patients.  Parsons' lawsuit alleges three violations: (1) Second Amendment violation because state law infringes on his right to keep and bear arms, and (2) Fifth Amendment violation because the act of having to register incriminates him in violation of his right to not incriminate himself, and (3) Right to Privacy violation because the state discloses his private medical information to thirds parties, including the DMV and FBI, which violates his constitutional right to privacy and also federal HIPAA laws through unauthorized and unwarranted disclosure of his private medical information.

Let me explain further what this complaint will do:

This complaint gives every Nevada citizen, including medical cannabis users, the right to keep and bear arms.  Our medical condition should not limit us in our ability to defend our person and our property and our families when our own state government makes us targets for violent crime by removing one of our most fundamental rights.  The Second Amendment Right to keep and bear arms "SHALL NOT BE INFRINGED"!  The constitution and our forefathers expressed this with four of the strongest words ever written : "SHALL NOT BE INFRINGED" and I intend to make the state of Nevada explain to all of her citizens why she INFRINGES on our rights in this matter.  

The next effect this complaint will have is that it will keep us from incriminating ourselves with the federal government.  THIS WILL NOT REMOVE THE MEDICAL MARIJUANA PATIENT REGISTRY CARD PROGRAM.   In fact, this lawsuit will return our privacy back to our doctors and away from the state!  We should not be forced to register our personal information or our private medical information to the state of Nevada so that they can turn around and share it with the DMV and the FBI.  This is obviously incriminating and NOT NECESSARY.

And this brings me to the final part of the complaint which is maintaining the doctor/patient relationship that is protected under federal HIPAA laws and violated by the state of Nevada with every application sent out.

It is your doctor that should be working with you to be treat your symptoms and ailments.  It is your doctor that should recommend how much cannabis you need.  It is your doctor that should be working with you and this information.  NOT THE STATE.  Not now, or ever.  This lawsuit will compel the state of Nevada to get the state out of our personal and private medical business.  It will also compel the state to return registration fees as damages for misappropriating access to the patient registry database over the last 15 years and leaving us vulnerable to "punishment through the process" as its called.  ENOUGH IS ENOUGH.
