On February 22, 2013 my brother was sentenced to Life in Prison for conspiracy to distribute marijuana. Federal case # 4:11-cr-00127-MAC-ALM-6
My brother is a great person, he adored and loved his three children with all of us heart, he still does. The police took him, along with 15 other individuals, out of Indiana down to Texas, where he has never lived. The judge was very harsh, and even though she has alternatives to sentencing, she chose life. We have found a federal lawyer by the name of Philip Lynch has offered to take on his case for $10,000. This is amazing for a federal lawyer, as most of them charge $60 - $70,000. Mr. Lynch just retired from the federal government and he is starting his own firm. Feel free to google his name to review his cases as well. We are asking for any of his friends or family, or ANYONE to help us. We need to raise $10,000 to hire him to handle the case. Should the laws of a modern civilized society permit a person to be sentenced to Life in prison Without the Possibility of Parole for selling Marijuana? How about for simply AGREEING to see some Marijuana? On February 22, 2013, 42-year-old, father of three, James Romans was sentenced to the rest of his Natural Life in prison after having been convicted at trial in Federal court for allegedly conspiring. that is, AGREEING, with others to see Marijuana.
The case started out as a State case in Indiana, in which James pleaded guilty to Financing a 24-pound Marijuana deal. this was the only Marijuana seized that was directly linked to James, And yet after the Federal Agents from Texas picked up his case, more than 10'000 kilograms were attributed to him based on uncorroborated testimony og Government witnesses who were testifying in order to reduce their own sentences, or to avoid charges altogether.
James has never maintained that he was not involved in selling pot. Indeed, as stated above, he plead guilty in Indiana State court to pot-related charges. However, from the outset, James has maintained that he was not involved in the separate and much larger drug conspiracy to which his childhood friends admittedly were involved in. That is why he went to trial.
At trial, James was represented by a court-appointed public defender. Almost from the beginning, however, there was a complete breakdown in communication between James and his attorney. Moreover, the attorney made no real efforts to challenge the Government's case. He conducted no pretrial investigation, interviewed no government witnesses, and spoke with no potential defense witnesses. He was basically just phoning it in.
This same attorney has now been appointed to represent James on his appeal. This is James' one and only chance to obtain direct appellant review of his case, and his attorney still will not even return his phone calls nor answer any e-mails: nor will the attorney respond to the calls or e=mails from James' family. James tried to get the Appeals Court to appoint a different attorney to handle his appeal, but the court refused to do so.
James and his family feel scared, helpless, and alone. To have the balance of his Life rest in the hands of an attorney who is so obviously ineffective and indifferent is, in many respects, a fate worse than death. James is a good, God fearing man with a loving and supportive family. The thought of spending the rest of his Life in a violent, hopeless, soul-destroying Federal Penitentiary is almost more than he can bear.
Thus, in a last ditch effort to literally try to save James' Life, James' sister is establishing a legal defense fund in order to hire a private attorney to handle the appeal. And thus the nature of this appeal for financial assistance. James and his family desperately need your help.
