January 9, 2015 marks 3 years since a witnessed slip and fall at WorldMark by Wyndham resort in Big Bear, California and Traumatic Brain Injury, #TBI.

Still waiting for medical care and benefits. Thousands and thousands of dollars have been paid out in evaluations; very little in the way of 'medical care' requested by treating physicians, beyond the nearly $30,000 paid for out of pocket.

Here's a video from December 2012.... Wyndham's defense firm failed to authorize brain injury evaluations or treatments requested by any of the doctors.  Defense firm threatened this doctor if he continued to treat me, which I paid for myself after waiting for care almost a full year.

 The insurance carrier refused to pay TTD in 2012/2013, apparently a common practice, approved by WCAB.  It earned them approximately $16,000 in bonus money when they paid EDD back in mid-2014, leaving me without benefits, treatment, and Wyndham's continued refusals to participate in FEHA required interactive process for return to work.  A Judge approved it, saying it wasn't the InjuredWorker's money the State gave to the Chicago insurance company.  It must have just been Taxpayer Money, less handling fees?

Adult Protective Services was helpful in 2014 regarding financial terrorism, and The Salvation Army was kind and generous about utilities and food and hope.  A local crisis center, and a Marine/Social Worker was also very helpful.

The Wyndham Long Term Disability carrier policy is on a month-to-month basis, although the policy indicates it it is to last until my 65th birthday.  "Evaluations" are being conducted with non-brain injury experts.

Social Security denials have come twice, and a hearing is scheduled.  Initial reviews indicated that SS knows there is a brain injury, insufficient to prevent selling of timeshare.

In the summer of 2014, while doctors requested 3-6 months of Brain Injury Rehabilitation care, by a quirk, 16 days were authorized, with an additional 8 days, then terminated.

In the fall of 2014, I self-procured treatment at the Coastline Acquired Brain Injury Program at Newport Beach, a brilliant program and part of the community college system to teach people with brain injuries compensatory strategies for return to some sort of life.
A discount rate at the RamadaInn-Newport Beach was reluctantly arranged by Wyndham HR, and the staff at the Ramada was so kind.

Affordable Care denied insurance coverage, something about they know I am disabled but not blind; DECLINED.

I retained 4 law firms; one for 30 days, one for 9 months, one for 90 days, and one for 45 days.  Each did more egregious harm than the prior, and they did, apparently, such a poor job, that while many SuperLawyers and SuperIdiots have been contacted, there is apparently a "2-attorney" taboo rule, so if an injured worker chooses poorly, or is tricked by an attorney indicating expertise in brain injury when it does not exist, too bad how sad.  A lien is placed on the case, and attorneys fight over dividing up "up to 15%" of often, nothing in terms of settlement.

In November 2012, defense counsel, having successfully avoided medically necessary treatments and expert evaluations repeatedly requested by multiple doctors, and by refusals to reimburse medical expenses and miles, they offered a $100,000 settlement number, less attorney fees, that required forfeiture of all future medical benefits, including social security disability, unemployment, and it required resignation from the job.

Well, Citizens, that is WorkComp in America.
