My background info: My name is Joe Mazziliano Jr. and I'm a 36 year old, freelance web developer from East Moriches, New York. I work very hard, I am college educated, I pay child support and I help take care of my father who has been battling some health issues in recent years. I share joint legal custody of my 9 year old daughter Kayla with whom I spend entire summers every year and on holidays when her mom decides to comply with the court order. I made a not so wise decision roughly 5 years ago to let her relocate from New York to Georgia with her mother. We have a very strong bond despite our physical distance from each other. We talk on the phone, do internet messaging 2-3 times a week, send things back and forth in the mail so I am in her life as much as I can be despite living 1,000 miles away. She also has a very strong bond with the rest of my family. She means the world to me and she is a perfect, sweet, happy, smart little girl who doesnt deserve what I am about to explain.
The Bad Situation: I learned over the last week that about a month ago Kaylas mom was put into jail - Click for news link. You can read about the details about what happened at that link. Luckily for everyone neither of her girls were in the vehicle at the time. Out of respect for the legal system I will point out that these are allegations at this time until proven guilty in a court of law but they have to be taken very seriously nonetheless. She has been held in custody since the incident. Nobody from her end told me about this incident and kept it a secret, I found out about it on my own during an internet search because I had a gut feeling that something was wrong.
Since this incident my daughter and her sister (whos daddy is also in a custody fight now) have been in the care of their 70 something year old grandfather. I was informed by him that they are in his custody and I have no rights to come take my own daughter back to New York. That isnt going to work for me obviously so I am reaching out to family, friends, acquaintances and the general internet community for a little bit of help with offsetting the costs of retaining a proper attorney and for the travel expenses I will incur going to and from the state of Georgia from Long Island, NY. I have been on the phone with my daughter on a daily basis, she is in good spirits and is looking forward to her upcoming summer visit with me. This entire situation caught me completely by surprise and I am now scrambling on very short notice to find attorney to take this case on. I am seeking sole legal and physical custody of my daughter so she can be raised in a safe, loving environment where she will get the proper parental care and extended family attention that she deserves.
I am not the type of person who reaches out for help but this is by far the biggest deal in my 36 years of life. The funds raised from this campaign will be used to help offset some of my attorney fees and travel costs, any remaining funds will be awarded to a childrens charity of Kaylas choice.
At this stage I have an emergency custody petition filed in my local county court where my original custody order resides and I am awaiting a hearing date to get this whole situation in front of a judge or magistrate for instructions on how to proceed to take custody of my child.
This is pretty much the gist of it for now and I will be updating this page as my case proceeds though the court system.
