Sued By My Deceased Wife's Caretake

This is a Civil Court abuse story.


I was sued by my mother's caretaker after she conned my 90 year old father out of $10,000.


She borrowed the money to make ethnic design blankets in China she was to sell for her business. After receiving the check she diverted $2,000 for another use breaching the contract. She then hit my father up for another $2,000 claiming the price for the blankets was changed by the factory in China, which was false. This was fraud. My father refused to give her more money and she defaulted on the final payment and the blankets were liquidated to a third party. I had to step in to save my father's investment by purchasing the goods from the third party. A lot more money had to go into shipping and duties etc. I offered the caretaker the same deal as before but I needed to be sure my father held the blankets to assure that she paid the loan back. She refused to cooperate, forfitted the goods to me in writing and then ended up suing me. John Burris took the case Pro-Bono and wielded the resources of his firm against me and at one point modified the suit to include my 93 year old father. After a very expensive $80k three year fight, we were forced into settlement to stop the money bleeding so the caretaker ended up getting her way. We lost $80k due to unfair backing by Burris and an inept or corrupt judge's refusal to throw the case out.

Their attorney, DeWitt Lacy claimed they paid a flat fee of something like $1,300 but with the case lasting over 3 years and enduring some 35 hearings, I'm sure Burris Law was paying DeWitt Lacy full rate. This meant his clients had no deterrent from dragging the case out and Lacy was receiving a cash incentive also to drag the case out as long as possible. He may have pocketed over $100,000 in fees in this legal harassment shakedown nightmare for my father and I.

The case was thrown out 4 times and was ordered to trial on the fifth attempt to have it thrown out. The judge seemed to favor Burris's clients even though there was no improvement in the complaint filed a total of 5 times. Judge Ioana Petrou ruled against my father and I after five attempts to have the case thrown out even though the Burris attorney and his clients didn't even bother to show up for the hearing and didn't even call with an excuse. I find this highly suspect and this judge needs to be investigated.

John Burris Law is a high profile "civil rights" law firm and often appears in press conferences speaking publicly as a pundit in racism and police brutality cases. He has been involved in litigating high profile, high $$ cases including Rodney King in his suit against the Los Angeles Police Department as well as the BART Police/Oscar Grant shooting. This guy chose to come after my father and I

He assigned DeWitt Lacy to take on the case. Lacy ran for Board of Supervisors District 10.,_2010

Both these men are public figures who need to have the truth about their malicious and unethical activities exposed.

In my opinion, It was nothing better than a nuisance-civil-suit shakedown of someone with assets by someone he took pity on regardless of the merits of the case. (Caretaker non-citizen Tongan and husband black/native American) They announced their marriage during the case gaining her citizenship in order to sue my father and I who are white.

Full Story:

My father was supposed to receive and hold the goods as collateral. When my father refused to give her another $2,000, she became very ornery and uncooperative while demanding raises. She was finally fired.

I had the contact for the factory in China so I contacted them and found that she was $2,000 in overdue final payment over three months and was refusing to pay even under threat of liquidation, selling the blankets to a buyer in China to cover her overdue payment. I contacted her and offered to pay the balance if she would stick to the original agreement for my father to hold the goods as collateral. She refused to cooperate after three weeks or so of negotiations and finally forfeited interest of the goods to me in writing in an email. I then had to go to the trouble of setting up the logistics of getting a container of blankets shipped from China, paying about another $6,000 in shipping and duties etc. It turned out that she was threatening the factory representative and fighting for the goods the whole time (even after it was fully paid off by my father) claiming ownership by contract even though she hadn't put one penny into the project. (she actually extracted $2,000 from the project)

I thought everything was done when the blankets were on the water in rout to the US but her and her husband filed a civil suit against me for Interference With Contractual Relations as well as other causes of action.

The case dragged on for three years getting thrown out four times due to lack of facts claiming actions on my part but the judges kept allowing them to re-file the complaint. The fifth time the judge ruled against us on our final attempt to get the case thrown out even though it was still the same case with no changes of substance. We were overruled even though the Burris lawyer or the plaintiffs didn't even bother show up for the hearing.

There's a lot more to this story but to sum it up my father lost the biggest fight of his life at 93 and my mother died while we were being sued. My father is traumatized and out $80k. My parents were always very frugal and as my mother grew up during the depression, clipped coupons for 60 years saving every penny as she only to have money burned in court by the bucket load paying lawyers in a totally frivolous suit. This outrage needs to be exposed to the light of day. This could happen to anyone at any time. This court system and a rich law firm aided an elder abuser.

Please help turn around the last fight of my father's life and help to restore my mother's honor.
