Bradley v. West Chester University - 3rd Circuit Strips Whistleblower Rights 

●      Colleen Bradley worked as the Director of Budget and Financial Planning at West Chester University and was fired for whistle-blowing regarding financial misreporting by the university.  She discovered West Chester, would consistently transfer the multimillion dollar surplus to various reserve accounts in the Plant Fund and thus display a much lower operating surplus to the Council of Trustees.   The practice of inflating expenses was a common practice amongst PASSHE institutions justifying the request for higher state appropriations, increasing tuition, retrenching of faculty, and failure to replace faculty and staff across the system.

●        The evidence points to fraudulent behavior and Ms. Bradley reported this up through her chain of command and as a result was fired by West Chester. She filed a lawsuit for wrongful discharge in violation of her First Amendment Rights

●         The Attorney General’s office and the Inspector General’s office failed to investigate or take any action in response to this case in response to the misreporting of financials.

●        In fact, the AG’s office is defending the case against Ms. Bradley arguing that her reporting is not protected by the First Amendment and that the state has an immunity from such suit;

●        The Third Circuit Appeals Court has agreed with the AG’s office and stripped state workers of their First Amendment rights to blow the whistle, a decision that will likely influence other Federal courts throughout the United States.

●        Bradley has filed an appeal (petition for a writ of certiorari) to the Supreme Court of the United States

●        A group of concerned faculty are raising money to file an amicus brief asking the Supreme Court to take the case to restore these First Amendment Rights

- Supporting Bradley's case will help all state employees who blow the whistle against state employers engaged in fraud and help all taxpayers by protecting those who expose the fraudulent reporting and spending of tax payer dollars

- Funds will be used to pay the expenses of printing, copying, filing and delivering the brief and the expense for admission to appear before the SCOTUS
