In late January, 2019, the Article 78 against Schodack Planning Board and Scannell Properties was dismissed by Supreme Court Justice Patrick McGrath. Birchwood Association was extremely disappointed and shocked with the decision.
The speed in which this project has been approved and blessed by first the town and now the court is mind boggling and in our view, reckless.
We wrongly assumed that the New York State environmental laws were in place to protect against exactly what has happened here. The developers and Amazon seem to be looking at this project as if it were a two day delivery. Some things are just not meant to be delivered overnight. Why our elected officials do not see the prudence in ensuring that taxpayers, homeowners and local environments are protected is a mystery to us.
The cost of and Appeal is an expense that we hope others will share the burden of. The immediate neighbors around the Amazon project site ask for your financial support be it $5 or thousands of dollars. Please assist us in making the legal case that a Full Environmental Impact Study (EIS) needs to be completed, before the Amazon project proceeds.
If ever a project needed a full EIS it is this one. Putting a million sq. ft. warehouse over the water supply for Schodack, Nassau, and Kinderhook without knowing what will be stored in the warehouse and what impact the warehouse will have on the aquifer and the environment surrounding the warehouse is absolute disregard for what is intended to protect them.
