To give you a brief timeline:
TIME LINE OF THE SELL OUT:

 2013: Fowler Energy and Multiband Engineering & Wireless pick up the pieces of the Clipper Wind Project near Calhan and repackage it under the name Golden West Power Partners, a shell corporation created only for this purpose.

 Mid 2013: Negotiations with Falcon residents along elevated transmission line ROW on Highway 24 go badly and Golden West agrees to bury the power line. Falcon opposition to the wind project is effectively eliminated.

 November 2013, Golden West notifies adjacent land owners of a BoCC hearing on the wind project featuring the buried power line through Falcon.

 December 19, 2013: BoCC hearing is held with no Falcon opposition, overwhelming number of proponents are invited by Golden West, 12 opposition residents from Turbine Array foot print near Calhan mount a protest. BoCC ignores all objections to wind project Turbine Array area and approves wind project 3 to 1 including buried power line along HW 24; Timing of approval allows project to qualify for essential Production Tax Credit (PTC); Fowler Energy, Multiband and Golden West have never installed a single turbine or one foot of transmission line; BoCC performs no due diligence, asks no questions, and is promised $1.625 million as part of development package, if approved.
o Next Era operative Spencer Cooreman sits in on Golden West hearing. Presence of Next Era representative is not revealed to public and no questions are raised by Next Era regarding the buried power line; negotiations between Golden West and Next Era likely to have been on-going for months.

 December 31, 2013: Twelve days later, Golden West interest in the project including the critical PTC “safe harbor” and the buried power line is purchased by Next Era.

January 2014: With no public announcement, Next Era abandons the approved buried power line option and begins preparation of unapproved elevated ROW through Falcon residential subdivisions, in cooperation with El Paso County Planning Department. Falcon and Eastern El Paso County residents are not notified of the change.

June 27, 2014: Next Era pays El Paso County $1.625 million promised at time of Golden West hearing on
December 19, 2013. The same day, Next Era West closes sale of critical parcel along elevated power line ROW for $274,900, closing the last gap in the circuitous elevated power line ROW route through Falcon subdivisions. How did they know the elevated power line would be approved on February 5, 2015, 7 months in the future?

December 23, 2014: Five months later, El Paso County Planning Department announces an amended Next Era Zoning Overlay, including the elevated power line that has been in development with Next Era for nearly a year. Delayed announcement creates crisis in community due to holiday season.

January 6, 2015: Planning Commission denies 6 to 3 amended Next Era plan based on a threat to Health and Welfare of Falcon residents along new elevated power line. Recommends denial to BoCC.

February 5, 2015: BoCC, in 15 hour hearing, sees overwhelming opposition to elevated power line, yet votes 4 to 0 to approve.

Post hearing interview with District #2 Commissioner, Amy Lathen reveals that Next Era purchased the Golden West interest in the project with full knowledge of the buried power line but always intended to obtain elevated power line approval in 2015. Ms. Lathen confirms that Next Era threatened to withdraw from the project and file suit against the county if the elevated power line was not approved on Feb. 5.
