KATHY'S STORY

On May 10, 1975, in Springdale Arkansas two men, one around age 40 and the other in his teens, yanked me off my bicycle as I was riding to church. They drove me to a ravine off Highway 265 and raped me in their pickup truck. They beat me so badly I nearly died. They left me for dead and I crawled to a nearby porch where a Good Samaritan woman turned on her porch light, scared the men away as they were coming back for me, and got their license plate number.  I lost consciousness and woke up 5 days later in the hospital.

It was a terrifying experience. I was twelve years old, a virgin before the attack. I don't remember if the doctor told me how many stitches it took to repair the damage they had done to my body, I only remember him telling my mother and me that my injuries were so severe it was 99% certain I would ever be able to have children of my own. (He was right). Needless to say, the events of that night changed my life forever.

Almost as painful and traumatic as the attack was what happened next, when I went to the police and the court system for help. The man arrested and charged with the crime was a 42-year-old factory worker named Thomas Alfred Taylor. His accomplice was a minor and would be tried seperately in juvenile court, his identity protected because of his age.

There was a mountain of evidence against them. A medical examination confirmed my injuries were consistent with rape. The younger attacker confessed, telling investigators he saw Thomas Taylor raping me and heard my screams. When Taylor was arrested, his underpants were still stained with my blood. But the case turned against me when Thomas Taylor demanded a new lawyer — specifically demanding a female lawyer — and a 27-year-old attorney named Hillary Rodham took over his defense.

Hillary then immediately began to attack my character. It felt like I was the one on trial. I have heard that Hillary filed more subpoenas in those few weeks defending a child rapist than are typically filed in capital murder cases. I was asked the same questions by investigators again and again, as if they were trying to catch me in a lie. I was hooked up to a lie detector test like a criminal and made to feel like I was lying and making up the rape. It seemed like it would never end. I was tired and scared and finally told my mother I wanted to stop. It wasn't until years later that I learned Hillary was writing things about me in private court documents that weren't true. In one affidavit she told the court I was "emotionally unstable with a tendency to seek out older men and engage in fantasizing." She attacked my single-mom upbringing, saying I came from a "disorganized" family which made me prone to "exaggerating or romanticizing" sexual experiences.

How can a rape be fantasized or romanticized when the rapist's underwear is stained with your blood? I realized later what Hillary was actually saying. She was saying that I wanted it to happen. These men weren't guilty of rape because I had invited them to have sex with me —at age 12-- that was Hillary's defense. It is one of the most disgusting lies anyone has ever told about me. I tried to put the case behind me but it was a struggle. For a while my life fell apart but I found my way back to God, and attend church regularly now. I was shocked to discover my attackers received such light sentences (Hillary got Taylor off with time served in the county jail, which was about two months). Still, for forty years, I kept my silence. That changed when I heard the audio tapes - audio tapes of Hillary laughing about my case. It's hard to describe how I felt at that moment. How could anyone laugh about what happened to me - a child violently raped? How could this same person claim to be a champion of women and children and be running for president? That was when I knew I had to speak out. I had to tell my story to the world.

My personal interest in Kathy Shelton's case began over a year ago when I started following her story online.  I decided to reach out when her identity was revealed in the recent Daily Mail article and was able to make contact through the author, Alana Goodman.  Kathy and I speak frequently now and have become friends.  I can't imagine the courage it took for her to come forward after 40 years.  My goal in starting this fund was to help Kathy cover a few essential living expenses --she urgently needs dental care-- and to provide her with some basic support while she continues her emotional and financial recovery.  Kathy was reluctant to ask for any help.  She really had no idea how many people were aware of her story.  She was overwhelmed with gratitude.  

I asked Kathy the other day what she most wants people to know about her.  Her answer speaks volumes.  She said: "I just want them to know I told the truth."

Jay Jay, the lawyer's duty to vigorously defend his client exists irrespective of the lawyer's personal perception of the client's guilt or innocence. It is clear that you don't fully understand this aspect of our law. The lie detector laugh was made in this context....He passed the test even though the lawyer didn't think he would, forever ending her faith in lie detector tests. Laugh. Period. There is nothing in this context, smart guy, that can remotely be attributed to a lack of sympathy for sex abuse victims. Lawyers are not simply allowed to walk away from cases they are appointed to irrespective of whether the client is guilty or not. Again, you demonstrate you lack of understanding of the law. I am concerned about the right of the accused. So is the Constitution. Amendments 4, 5, and 6 are primarily designed to protect the rights of the accused. Read them. You do like the Constitution don't you? P.S. I am not at war with the internet but you seem to be waging a losing battle with the truth.

Unfortunately Hilary was just doing her job then because in America even scum like rapists are given a lawyer. She never laughed at you, she laughed at polygraphs, and said she forever lost her faith in them because the man passed it. Angie, I'm wondering why my comment was deleted. It did not attack Kathy, though I did question why this campaign is so political. Again, Ms Clinton (then Ms. Rodham) did not reduce bail for the defendant, she did not give him a light sentence or cause a plea deal to happen, she did not mess with or misplace the evidence, and her request for a psychological evaluation for Kathy was denied by the judge.

I sympathize completely with the victims of sexual assault. However, Ms. Shelton's story needs some clarification. First, Hillary did not "take" the case in the sense that she actively sought to represent the defendant. She was appointed by the court to represent him. Once that appointment occurs, the lawyer has one primary obligation--to defend their client. Ms. Shelton asks "Why would she release him?" regarding the defendant's making bail prior to trial. A defense lawyer does not release their client from custody. Reasonable bail for such crimes is constitutionally required. The bail amount is set by the court, not defense counsel. Defense counsel regularly assist clients in bail matters. However, Hillary did not set the conditions of release or authorize his release, the court did. As far as Ms. Shelton's complaint about accusations about her raised in documents filed on the defendant's behalf, the record is clear. In support of a motion for psychiatric examination of Ms. Shelton, Hillary advised the court that she had received such information from other sources during her investigation of the case. She did not swear to the truth of the underlying allegations. In bringing the motion, defense counsel was representing her client consistent with the law as it then existed. For what it is worth, the court denied that particular motion. Ms. Shelton complains about being repeatedly questioned by investigators. All such interviews were likely conducted by the police, the district attorney's office, or social workers. All such persons work on behalf of the state, not the defense. That is not to say that these interviews were not emotionally distressing. They undoubtedly were. However, they were not likely conducted by or for the defense. Hillary does laugh at several points during a lengthy recorded conversation about the case. However, these laughs are contextually appropriate and cannot reasonably construed as being directed at or about Ms. Shelton or her status as a victim of sexual assault. Finally, Ms. Shelton is dissatisfied with the way the cases of both defendants resulted in little punishment. Hillary did not assess punishment, the court did. A plea bargain between the defendant and prosecution was reached that the court approved. This is standard practice in the vast majority of criminal cases and involves the consent of three parties, each with different ethical obligations. The way an adversary legal system handles sexual assault cases is not pretty and there is certainly room for improvement. However, I am convinced it is the best system the mind of man has been able to conceive to date to both prosecute the guilty and defend the wrongfully accused.

All the reports I have read on this say These were people Kathy knew, one was a 15 year old cousin, not involved in the rape. This happened in 1975 when she was 12 and there is no doubt in my mind this is how she remembers it and she was traumatized by not only the rape but the trial. This is way before any protections for rape victims. However it was not Clinton who ruined her life, it was the rapist and the irresponsible prosecutor and police force that lost DNA evidence. Clinton was asked by the prosecutor on behalf of the judge to represent this man because he requested a woman and there were only 6 in the county.
