Homeless Shelter Accountability (not taking $ now)

We are assembling a group from the neighborhood to pursue legal options to not allow The INN Between to have a homeless shelter/facility at 1200 East and 1300 South. If we are not able to stop them we hope to limit their capacity to 25 beds (their ultimate goal is many more, but this number has changed several times, we have most recently been told 75 beds) and ensure proper oversight. 

While we are not opposed to helping the homeless population and recognize the value of The INN Between’s mission to help, we are opposed to housing homeless individuals in a residential neighborhood. Hillside is not zoned for a homeless shelter and it appears The INN Between has manipulated things in order to accomplish this.

The more participants there are, the stronger the likelihood for success will be. An attorney is willing to take our case. 

We need individuals that are willing to contribute financially and that are willing to discuss the detrimental effects this is likely to have on the neighborhood and the enjoyment of their property.

Some of the facts:
- The INN Between's owner marketed this facility as a 25 bed hospice.  She received money from numerous parties with the understanding that this was a hospice for terminally ill homeless individuals.  However, only a small percentage of the individuals taken in have a terminal diagnosis.  A person does not require a terminal diagnosis to qualify at the INN Between.  Any homeless person with a medical need and written referral can stay at the facility. 

- During their stay, homeless individuals are free to come and go.  When they are finished at the facility many are released back to the street. (This could be your street)

- Located less than 700 feet from a montessori preschool, and in between Emerson and Uintah Elementry Schools. By law, a homeless shelter must be at least 1000 feet from any school (why do you think that is? This is concerning)

- At the previous location, at least two known sex offenders were staying at the INN Between, one of which was named The Most Dangerous Man in American Fork. However the surrounding neighbors were not informed. The attorney that represents The INN Between stated, "The INN Between does not admit residents who are believed to be a danger to other residents or the community". (Seems very concerning)

- The INN was given a one time $975,000 gift from the State, which was used for the purchase of Hillside Rehab. This money came from the $10,000,000 allocated for the homeless.  Additionally, according to the The INN Between's attorney, they were awarded a one-time $500,000 Community Development Block Grant through a special Salt Lake County CDBG initiative specifically targeting homeless facilities, which was approved by the mayor.  However, the attorney also stated The INN Between has not "not sought or received any special treatment from any government body or regulator". (Okay, this is beyond concerning!!)

- The sale of Hillside Rehab to The INN Between was considered a “private sale” even though tax dollars are being used. (This seems to be setting a very bad precedence for this to occur in any residential neighborhood)

- Interestingly, The INN Between included the following definitions in a letter to us: 

“Assisted Living Facility” is defined in the Salt Lake City Code § 21A.62.040 as “A residential facility, occupied by seventeen (17) to twenty five (25) individuals, licensed by the state of Utah under title 26, chapter 21 of the Utah code or its successor, that provides healthcare and assistance with activities of daily living and social care, including hospice care and respite care, as defined in Utah code section 26-21-2 or its successor.”

“Eleemosynary Facility” is defined in the Salt Lake City Code § 21A.62.040 as “A facility operated by a nonprofit charitable organization or government entity to provide temporary housing and assistance to individuals who suffer from and are being treated for trauma, injury or disease and/or their family members. Eleemosynary facilities are traditionally not funded wholly by government but are usually supported by philanthropic, corporate, and private funding. The term ‘eleemosynary facility’ does not include places of worship, social and community services organizations, homeless shelters, homeless resource centers, community dining halls, group home dwellings, residential support dwellings, and other similar facilities.”

It seems the INN Between is operating under these titles but NOT abiding by the definitions, similar to calling themselves a hospice, but the residents NOT having to have a terminal diagnosis. (You know what I'm going to say here: THIS SEEMS TO BE BEYOND CONCERNING!!! YIKES!!!)

What are the main concerns?

Some homeowners in Sugarhouse have expressed concern that proper zoning and licensing procedures have not been followed, nor has public input been sufficiently considered, in relocating and expanding several facilities aimed at serving Utah’s homeless population. Of most immediate concern is a care facility called The Inn Between, which has recently relocated to 1216 E 1300 S, and which has plans to substantially expand its footprint at that location. These concerned Sugarhouse residents support the advancement of valuable homeless resources in our community, but they have some concerns about the zoning approval process and the proposed expansion of The Inn Between.

What legal support do we propose?

In order to address these concerns, we would like to investigate the proposals and legal requirements to ensure that The Inn Between and any other similar facilities in the area are following the proper procedure for seeking zoning and licensing approvals. We would also like to challenge the expansion of The Inn Between’s existing facility. As a part of this process, we propose forming an LLC in which community members can organize and collect funds for these purposes.

What are the costs?

To begin, we will need to take some time to investigate the issues, form the LLC, and send any appropriate notices to the City regarding our potential objections to the expansion of these facilities. We estimate that this will cost around $5,000.
