Yes, I need help to get back on my feet. Currently I am almost homeless. I have not pay October 2017 rent. Soon my utilities will be cut off because I can not pay them. Yes I have been applying for jobs, going to interviews and no offers yet.

The person that owes me over $31K prefers to pay an attorney to make my life harder and by intimidating me. This person is throwing two lavish parties at Universal Hilton Hotel and Hotel Irvine this month. Also this person rents two homes. One in Tarzana with 3 beds and 2 baths where he rents to make income from it and one in Witnetka with 3 beds and 2 baths. While he has a roof to sleep under, soon I will be leaving under the freeway, just because I lend money to the wrong person who has no heart.

I realize this person has taken the matter personal and he is not a good person neither a good citizen rolemodel. Yes he is a  public person and I know he is reading this and bitching about it instead of resolving the problem by fixing it.

It is hard for me to start this campaign and ask for money but sometimes for been nice to others we learn the lesson not to be nice to some people, especially from Iran Tehran.
I have not been working a full time job for over 3 years, so I am running out of money.  Your donation will help me to be able to survive and win this lawsuit because it is not fair not to get paid when you lend somebody money because you felt sorry about them.


Here are the facts:
On December 18, 2014, Mr. Esteban Escobar (Plaintiff) lend Mr. Shahbod Noori from  Tehran Magazine formerly Tehran International Weekly Magazine Corporation $15,000.00. Mr. Shahbod Noori promised to pay the loan back by June 30, 2015 by giving a postdated check dated 6-30-2015 in the amount of $17.000.00 + $200 late fees per each month after if loan is not pay in full to Mr. Escobar.

Defendants Shahbod Noori from Tehran Magazine formerly Tehran International Weekly Magazine Corporation asked for the loan with the purpose to buy back his home office property located at: 6134 Tampa Avenue, Tarzana, CA 91335.

Defendants Shahbod Noori from Tehran Magazine formerly Tehran International Weekly Magazine Corporation even offered to secure loan with his home and cars.

As you may read Defendants Shahbod Noori from Tehran Magazine formerly Tehran International Weekly Magazine Corporation committed fraud in order to get the loan due to the fact that per Los Angeles Assessor office he do not own the above property.

          Mr. Escobar tried to cash the postdated check more than three times on September and October 2015, but it was returned as non-sufficient funds by Mr. Noori’s Bank of America bank.

Steven Escobar gave many opportunities to Mr. Noori to pay the money back but he would not pay it. He states he has no money. So Mr. Escobar filed a lawsuit at LA Superiourt court in Downtown Los Angeles case#15k14862.

Mr. Escobar hired an attorney Steven E. Weitz
at the begginning of the lawsuit to do the legal representation, filing and paperwork. Mr. Escobar attorney at the time, set a deposition for Mr. Noori and his attorney of record Mr. Michael H. Moghtader
for May 3, 2016, but both did not show up.

As you read a Discovery notice of taking deposition of the Person Most Qualified at Defendant Tehran International Weekly Magazine was served on April 1, 2016. Deposition of the Person Most Qualified at Defendant Tehran International Weekly Magazine was schedule at 20750 Ventura Boulevard, Suite 205, Woodland Hills, California, on Tuesday, May 3, 2016 at 9:30 a.m. There was no appearance by defense counsel Michael H. Moghtader and no appearance by anyone from defendant Shahbod Noori or Tehran International Weekly Magazine Corp.         

A good faith effort has been made to recover the Defendant’s responses.  On May 13, 2016, an invoice for $195 failure to appear at schedule deposition was email and mailed to defense counsel Michael H. Moghtader. Also on May 26, 2016, a letter with invoice for $195 was mailed to defense counsel Michael H. Moghtader regarding the failure to appear at schedule deposition. As of this date, there has been no answer from defendant Shahbod Noori or defense counsel Michael H. Moghtader from MHM Law Group, APLC.

So Mr. Escobar filed a motion for a Motion to Compel and sanctions againts defendant Shahbod Noori and defense attorney Michael H. Moghtader from MHM Law Group, APLC., for action as well due to the failure of Defendant counsel to appear at schedule deposition. Also an invoice for the expenses accrue for the deposition of $195 as well for the loan debt of $28,941.40 has been e-mailed, faxed and US mail to Defendant counsel at the time.

On 1-18-2017, Mr. Escobar contacted attorney Michael H. Moghtader from MHM Law Group, APLC., to relate what Mr. Noori told Judicial Officer Judge Honorable Andrea C. Thompson.  At the hearing with Defendant Shahbod Noori, he lied under oath, he stated in front of Judge Honorable Andrea C. Thompson and the court reporter that I will not receive any money on this case #15K14862 because he will or has filed a Bankruptcy case.

On 1-18-2017, Mr. Escobar learned of new information about this case, so he  filed Notice of Motion and Motion for Leave to amend complaint at the Los Angeles Superior Court. Part of the motion reads: The motion is brought on the grounds that: (1) Plaintiff has recently discovered new factual information to support adding an additional separate cause of action alleging “Fraud” arising from the same general set of facts; (2) Plaintiff has also recently discovered new factual information to support adding an additional separate cause of action alleging “Fraud – Conspiracy to Commit Fraud” arising from the same general set of facts; (3) Plaintiff has also recently discovered new factual information to support adding an additional separate cause of action alleging “Defamation” arising from the same general set of facts; (4) Plaintiff has also recently discovered new factual information to support adding an additional separate cause of action alleging “Copyright Violations” arising from the same general set of facts. Accordingly, no prejudice will inure to Defendants if the requested amendment is permitted. This motion will be based on this Notice of Motion and Motion, the Memorandum of Points and Authorities, Declaration of ESTEBAN ESCOBAR, PLAINTIFF as served and filed wherewith, the records and file herein, and on such evidence as may be presented at the hearing of the motion.

Instead of paying the money back Mr. Shahbod Noori from Tehran Magazine has done Fraud under the bankrupcy laws to Mr. Escobar. The money Mr.  Escobar lend to Mr. Noori to buy back the property was never bought, instead he used the money for other things.

On 2-14-2017, Mr. Shahbod Noori from Tehran Magazine formerly Tehran International Weekly Magazine Corp., filed for Bankruptcy Chapter 7 at the San Fernando Valley Bankruptcy court case#1:17-bk-10383-MT

Again Mr. Escobar has no other option to file an  Adversary case 1:17-ap-01043 on 5-1-2017.  
Adversary case Complaint by Steven Escobar against Shahbod Noori , Mastaneh Ekhtebar , Tehran International Weekly Magazine . An Adversary case is a lawsuit on the bankrupcy court. So here are the actions of the Adversary: Nature of Suit: (41 (Objection / revocation of discharge - 727(c),(d),(e))) ,(11 (Recovery of money/property - 542 turnover of property)) ,(13 (Recovery of money/property - 548 fraudulent transfer)) ,(62 (Dischargeability - 523(a)(2), false pretenses, false representation, actual fraud)) ,(91 (Declaratory judgment)). The bankrupcy court has issue a hearing for 7-5-2017 at 11:00 am at the United States Bankruptcy Court, Central District of California
21041 Burbank Boulevard, Woodland Hills, CA 91367.

As you read, because of the banrkupcy court, the LA Superior court motions has been postponned until the bankrupcy court makes their ruling on Mr. Noori Bankrupcy case. However because of Mr. Escobar Adversary case there has been no decision on Mr. Noori Bankruptcy Chapter 7.

Yes, Mr.  Shahbod Noori has not paid anything, nor has made any intentions in paying the loan back. Instead he is waiting on the bankrupcy court and using LAPD Topanga division to harrass and intimidate Mr. Escobar on his US Constitution 1st amendment rights.

Currently this case has reached more than $31K with court filing fees, attorney expenses and much more.

I ask you to help me continue fighting this unfair treatment by Shahbod Noori from  Tehran Magazine formerly Tehran International Weekly Magazine Corp. aka Tehran Magazine. The money you donate will help to continue filing motions and cases in court and also will help me to survive during this hard times.  I have not been working a full time job for over 3 years, so I am running out of money. Yes lawsuits are very consuming but it is not fair that Mr. Shahbod Noori understand what "honor" means.

Mr. Escobar who is one of the creditors listed on Mr. Shahbod Noori bankrupcy court case is an individual not a corporation neither an insurance company. So Mr. Shahbod Noori should pay the $30K to Mr. Escobar.

Mr. Shahbod Noori and Steven Escobar used to be friends. Not sure why a friend would ask for a loan and then he has no intentions in paying the money back.
