The Basics
   My dear friend Yvonne Mendoza, more affectionately known as  "Yaya" by Kingston , needs to raise $3,500 to hire a family lawyer to pursue custody of her three- and -a -half year old grandson he has lived with her since the day he was born, and she has been independently raising him for the last two- and - a - half years.
The Situation 
   Due to mental health instability and substance misuse issues, his mother is unable to care for him on a full-time , long-term basis and abandoned him, leaving him with Yaya when he was around one year old. While his father had been given visitation rights through a child support case he filed himself , he never requested any of his possession time with Kingston.  Even though there were no requested visits from King's father, Yaya was insistent on fostering a relationship between Kingston and his 9 month old sister, paternal grandmother,  and paternal aunt through weekly visits.

A few weeks ago, Yaya suggested to Kingston's father that he begin having his regular court ordered time with Kingston.  Kingston's father did not request or follow through with his time with Kingston. Even though there were no requested visits from Kingston's until he showed up at 9am for an unplanned visit on Sunday, June 17th, for Father's Day. Yaya agreed to the visit, but Kingston was not returned home at the appointed time. When Yaya attempted contacting his father he did not respond until 11pm and refused to return Kingston to Yaya. Despite repeated attempts to pick him up, Kingston's father continues to refuse to allow Kingston to return home against court orders.

According to the Texas Supreme Court, grandparents are within their rights to pursue custody of children they have raised in a parent-like role on a day to day basis for more than six months. Yaya was advised by both the police and a lawyer that this must be resolved through the court system, and that only the courts can order Kingston's father to return him to his home . While Yaya does not wish to prevent Kingston's father from seeing him, she is desperate for him to return to his home with her and sing "This Little Light of Mine" before bedtime. 




How You Can Help

Yaya needs to raise a total of $3500 to retain a lawyer to begin court proceedings.  This includes a retaining fee and cover an estimated 10 hours of work. Please help her get Kingston home to his puppy Rockee an all the people who love him!
