Cari Searcy and Kimberly McKeand have been together for 16 years and were legally married in California in 2008. Together, they share in the parental responsibilities for their son. For the past eight years, Searcy has been denied the right to adopt the child because of Alabama’s ban on same-sex marriages. In the process, the couple’s legal bills have mounted, and are now in excess of $50,000.

On Friday, January 23, the couple got a ground-breaking victory when United States District Judge Callie V.S. Granade struck down Alabama’s constitutional ban on same-sex marriage. A motion to stay was filed by Alabama Attorney General Luther Strange that day. On Sunday, January 25, Judge Granade granted a 14-day stay on her Friday ruling. This allows Attorney General Luther Strange to file a stay with the 11th Circuit Court of Appeals.

The decision will be handed down by February 9th or possibly sooner.

“We respect Judge Granade’s decision and look forward to February 9th when same-sex marriage will be recognized across the state and all of Alabama’s citizens can enjoy marriage equally,” said Attorney Christine Hernandez who represents the Plaintiffs.
