To fund Civil rights case v Florida
Greetings everyone. My name is Jean-Elie Uriel Charlemagne and I would like to tell you a story that is currently effecting every single American wether they are aware of it or not.
My Brother Emmanuel Michael Charlemange is currently incarcerated in Miami-Dade County Corrections and Rehabiltiation facility. The reason Judge Jose L. Fernandez arrested my brother is because my brother would not provide the Judge his personal address. Emmanuel Michael Charlemagne has been incarcerated since Janurary 4th, 2016 to the present.
My brother and I were arrested last year on July 10, 2015 for alledgly running a redlight on our bicycles. My brother spent 26 days in jail and I spent 21 days in jail.
Since then my brother and I have been going in and out of jail in attempt to deal with this issue.
Recently I was jailed for 15 days because I was late to a court date that I was not even aware of on January 13, 2016 by Judge Cristina Mirranda.
I am raising the money because I have recently been fired from my job due to the multiple arrests, unscheduled time from work, and to fund this litigation that is now moved into United States District Court Southern District of Florida (Miami). The money will be used to pay legal fees.
My family and I are in need of your help as soon as humanly possilbe. The bills are mounting and this is all due to the misconduct of our public servants. This is an issue that is happing all throughout America. The difference in this case is that this case has the potential to heard nationwide and help millions of other helpless Americans that are in similar situations.
The reason this means so much to me is because my brother does not belong in jail. Emmanuel is a very honorable, honest, sincere, giving, individual. My brother did nothing wrong to begin with and the North Miami Police Department should have never arrested him in the first place. This ordeal has been very tramatizing to my brother and our entire famliy. These actions by North Miami Police Department, and State Of Florida does not add value to our nation's principles of Freedom, and Constitutional Rights.
My family, friends and I are very thankful for your help. After the successful outcome of the litigation I look foward to giving back to others that are in similar situations.
I would like to update everyone about the current situation that is unfolding within the Malicious Prosecution that is being charged levied against my brother and I.
Just a side a note last Sunday 04-03-2016 I was robbed of all my camera, IDs, and other personal items that was in my black bag. I was with a friend at the a public park. I mentioned this so that the rest of the update is understood.
Emmanuel signed a motion that was drawn up by his Lawyer to have the case dismissed and released. I am cautiously hopeful that he will be released soon. From my understanding it was submitted today, and is expected to be ruled in perhaps 10 days.
I am happy to announce that Emmanuel will be having a very competent attorney on his side very soon. My and friend and I will be meeting with a very well known lawyer in the Miami Area. I am hopeful that Emmanuel will get out jail very soon. I can not thank you all enough for all the continued love and support throughout this entire ordeal. I know it's been awhile since I have updated you all. I want to let everyone know that Emmanuel is doing okay.
The STATE OF FLORIDA has appointed Emmanuel a private counsel. Emmanuel's private attorney is trying to get Emmanuel to plea out to a lesser charge, and have Emmanuel take out his paperwork within the file. Emmanuel has never consented to his counsel.
Emmanuel's trial is coming up on Monday 28, 2016. I am in the process of going to get a "Lawyer" very soon. The Lawyer's retainer is $3,500 to make sure that Emmanuel is freed from jail and to fight tooth and nails to make sure that he's not convicted of anything. I will be withdrawing out the funds to make a payment towards lawyer's fees. The payment will be $250.00 every two weeks. The goal is get Emmanuel out and released as soon as possible, and to make sure that he has someone that is truly fighting for him. It is obvious that the Honorable Judge Cristina Miranda has it out for Emmanuel and I.
I would like to humbly thank everyone for their love and support during this trying times. I will continue to keep everyone updated.
I spoke with a Lawyer a few days ago about finishing getting Emmanuel out of jail while I turn myself in. Before I continue I want to say this; I will not name this lawyer by name, but I will say that he was very nice and candid which was refreshing. After explaining to him what was happening he was able to quickly discern the situation. From what I conveyed to this Lawyer, he explained to me that perhaps Judge Cristina Miranda would like to have Emmanuel and I in jail because our claim is making her job difficult. Judge Miranda has to actually do her job according to the Constitution of the United States of America. After talking to him I quickly learned that we would not be able to pay his retainer. The Lawyer charges $10,000 to file the paperwork. Another Lawyer explained to me that the only way he would take the case was for $50,000. Now to be honest these prices seem high, but to be fair this is just an excellent example that everyone's time is MONEY!
The other night, I spoke with Emmanuel for about an hour. My friends, I would like you to know that I am very proud of my brother. I'm not just proud of him because he's my brother. Allow me to explain briefly the sentiment that my brother is articulated very well in the video. This ordeal that my brother is going through was brilliantly written recently by an author called Peggy Noonan from the Wall Street Journal describing how Donald Trump is beating the Establishment. Peggy talked about stages of grief based on Kubler-Ross. The Stages are as follows:
Initially on July 10, 2015 my brother and I were in Denial of just how corrupt our Criminal Justice System really was. To be honest we should not have been in denial. Our history with the Criminal justice system has not been kind to my brother and I since we've moved here to Miami. Emmanuel and I have gone through Kubler-Ross's stages really fast, and Emmanuel, and I have now come to accept that the rule of law is completely gone for those of us that have limited resources. The video you're about to watch starts off at the front of North Miami Police Station, and a sign saying, "To Protect and Serve".
The entire theme is centered around the word "PROTECTION". North Miami Police officers, City Council man/woman, Dade-County Mayor, Prosecutors/ Judges all consider themselves accomplished and successful. Perhaps all of the their accomplishments are valid and merited. I am not questioning the validity of their accomplishments. What I am questioning is the world that these accomplished and successful people are creating for the rest of us. Policies that these officials draw up for us to follow seem to "PROTECT" the accomplished and successful people in our community not only in North Miami Florida, and Dade-County, but throughout all Counties and every State in the Union where all Accomplished, and successful people reside. These people are from all walks of life. Former All Pro Tight End of the New England Patriots Arron Hernandez was afforded all of his Constitutional Rights until he was found guilty of murder by a 12 men/women juror. George Zimmerman father served as a Supreme Court Magistrate in Virginia court system. George Zimmerman's trial was very public and his rights were carefully "PROTECTED" by the court. These are just a few cases that I can think of off the top of my head. This is to illustrate that there is a different America that we all live in based on your economic status. George Zimmerman, and Arron Hernandez both had or have economic resources to defend their rights. Although both of these cases had a very different results, neither defendant can say that their rights were violated, or that the police mistreated, or the Judge was prejudice or bias towards them. Furthermore, because of who Mr. Zimmerman's father was, a judge himself, George was protected from the harsh reality that millions of other accused have to face with everyday. Arron Hernandez was able to afford the dream team lawyer that delayed the trial for months just to ensure that his rights was acknowledged. There are countless of people like the two I just mentioned that have power or access to power to "PROTECT" themselves from the harsh reality of our current Criminal Justice System. As a result there is a class of "PROTECTED PEOPLE" that live among us with complete immunity to the policies that we the little guy have to follow or otherwise face prison for the slightest infractions. (As I write this blog, I have Bail-bond Man Express blowing up my cellphone (305) 477-9600 and (786) 306-9896) These individuals live in the best part of town. Their children go to the best private schools in town. They have money in their banks accounts and do not live paycheck to paycheck.
The other America that is left is for the "UNPROTECTED PEOPLE". Many of you are already aware that "UNPROTECTED PEOPLE" live in economic deprived neighborhoods. The families of the "UNPROTECTED PEOPLE" are broken up, and if they are not broken up when dealing with a bureaucrat it will be by the time it's all said and done. The communities of the of the "UNPROTECTED PEOPLE" are not safe. In the community of the "UNPROTECTED" we hear every night of gun violence, and the solution is always to deprive those community of their individual rights to "PROTECT" the community from itself. This America for the "UNPROTECTED PEOPLE" are for the most part ignorant of their power, and does not have access to power like their counterparts the "PROTECTED PEOPLE".
I have called many law firms and in hopes of contacting a lawyer that would be able to genuinely, rigorously, fight to protect our rights, unfortunately their fees are out of Emmanuel and I's reach. I am not sure how much more time I have to report to you all, but please help if you can. Like Emmanuel says, "Why does someone have to get hurt before we act? Let's not wait till someone gets hurt, let's stand up together right now." Friends and family please try to understand that Emmanuel does not want to be in jail. I do not want to go back to jail either. My entire family would like this ordeal to end. Emmanuel and I have come to accept that for a long time that we are not part of the "PROTECTED PEOPLE OF AMERICA". The main lessons that Emmanuel and I have learned is that the "UNPROTECTED PEOPLE'S TIME IS NOT WORTH MONEY."
The retainers are too damn high for this respective case. No felony was committed but in all respect a court is mandated on proof of you being indigent to provide counsel. That counselor is supposed to treat your case with the same magnitude as a paid attorney.

The retainer are what they are. I agree with you that no felony was committed. That's what Emmanuel and I have telling Cristina Miranda all along. Miranda thinks that she is just an extension of the District Attorney's Office. From what I've found out she use to be a prosecutor years back. I can assure you that the counsel that they had appointed has never taken the case with the same magnitude as a paid attorney.
