Wrongful arrest of domestic violence victim - Maine

Donation protected
My husband and I were sent harassing messages on June 6, 2024, while we slept at my apartment in Lewiston, Maine. The messages were sent from 330 miles away by our now former tenant/roommate. He claimed to have been shot by friends of our son...it was a lie.

In the beginning of July, we went to Aroostook County. After a family gathering on July 8, we arrived at the home, and my husband didn't have his key to get in. Kevin didn't come to the door, despite his two dogs barking. We called the police, and Kevin did eventually open the door.

Then, on July 10 because of his erratic behavior - yelling at his brother and I as we stood in the driveway - I called the police again. The same officer responded: Corporal Ted Martin. On July 8, I had told him about Kevin's texts sent the previous month. We showed him the dent that Kevin had put in his car earlier in the day by throwing a cup at it. Martin again failed to take my complaint, and without probable cause or warrant, after speaking with Kevin inside the home, came out and arrested me!

I am being prosecuted for Attempted Disorderly Conduct. I live 330 miles from the courthouse. Kevin's texts are threats, and Officer Martin should have given him a warning, or arrested him. I sent a copy of the texts to District Attorney Todd Collins in Aroostook County; however he hasn't made them part of the file for my case, AROCD CR 2024 20209. I have recieved no report for July 10, the night of my arrest, and the July 8 report contains lies and redactions. naccuracies and it is not in my file.

I have been offered a deal: pay $300 and the case will go away. I asked the judge, Carrie Linthicum in Fort Kent District Court, before she transferred the case to Superior Court "Who is the victim?” She replied "The State of Maine." This is extortion, disguised as justice. I will not pay the state for me being wrongfully arrested.

I have been quoted $2500 as a retainer to defend against the bogus charge. I hope to also find a lawyer to file a civil lawsuit against the officer...if I can find an attorney brave enough to go up against a corrupt justice system.

I filed a complaint with the Office of Professional Standards. I received a phone call from Officer Christopher Tupper, who said he'd look into it; however accountability of their own for misdeeds and violations of the law is not a strength of the Maine State Police. Tupper was reprimanded in 2019. https://www.pressherald.com/2021/04/18/read-the-maine-state-police-discipline-records/
The newspaper allows a certain number of reads. Here's the pdf in case you can't get to the Press Herald story. https://specialprojects.pressherald.com/msp-2021/pdfs/Chris_Tupper.pdf
