WI Floodplain Change

On March 3, 2020, Governor Evers signed our bill into Law. We have a new WI floodplain LAW which will help EVERYONE who owns a structure in a floodplain. The 50% provision has been eliminated for structures which are elevated above the BFE. The state also recognizes several forms of elevation. People living along WI rivers who have struggled with improving their homes and making them flood proof, can FINALLY move forward. This has been a long and expensive process. Senate bill SB #637 has passed unanimously and with bipartisan support, out of Senate Committee.
Assembly bill AB #721 just passed unanimously with bipartisan support. We are only 3 steps away from getting this bill passed, however we NEED to cover the expenses incurred during this process.

The Mt. Trempealeau Corporation is a registered lobbying principle, seeking a policy change to align Wisconsin's 50% floodplain zoning requirement with federal rules. The state restriction imposes a lifetime spending limit of 50% of the “assessed value” of a nonconforming structure in the floodplain. This change would alleviate misinterpretation of what is ordinary maintenance and repairs and still comply with federal law so flood insurance eligibility would not be compromised.
This change would allow buildings to be elevated out of the floodplain. Once the building has become compliant, homeowners would be able to maintain and improve their home, ultimately generating a larger tax base for their community. A win-win for everyone.
