The concept of "gendered identities" in Norwegian Law
Norway introduced the concept "gendered identity" into their discrimination-laws in 2013 and self-id of legal sex via stealth in 2016. This means that it is no longer possible to differentiate between biological sex and the concept "gendered idenitity", and with this, not possible to differentiate between female and male. Self-id was made without any consideration of the role biological sex plays in relation to rights and guidelines - namely to women and girls, whose rights are developed in order to avoid discrimination on the basis of sex. Self-id results in legal and cultural blind spots where women’s rights in effect becomes annulled. For instance, women and girls are no longer guaranteed that the spaces and services that was previously understood to be women-only do not include men. Further, due to the 2013 discrimination law, it is considered discrimination against women to exclude men from such spaces. The spaces in question include changing rooms, toilets, shelters and prisons. The services or provisions include women-only sports and temporary measures such as quotas or bursaries.

The inclusion of the concept "gendered identities" makes it impossible to uphold rights and leglislations that are developed to avoid discrimination on the basis of biological sex. This is in effect an erasure of women’s rights.

The concept of "gendered identities" in Norwegian hate-crime laws
Norway introduced the concept of "gendered identity" into norwegian hate-crime laws in 2021. I attended the hearing to warn the justice commitee that to certain groups, biological sex is in and of itself considered hateful, and that the abuse of the hate-crime laws against women who talk about the relationship between biological sex and women's right would therefore be unavoidable. Now I am facing the exact scenario I warned against; all interactions I have had with an employee at Norway's leading LGBTQ-lobbyorganisation has been reported to the police as hate-speech, and is currently under investigation. I face the risk of up to three years in prison.

Police investigation
The statements that has been reported are statements referring to the relationship between biological sex, women’s rights and children's safety. I have been campaigning since 2020 for the reaffirmation of women’s sex-based rights and children's right to protection. The reported statements include one hearing and references to one TV-appearance, as well as tweets and facebook-posts made during an entire year.

This is new territory in Norwegian law. It may seem obvious that such an outright attack on freedom of speech, democratic processes and women's rights should be dismissed. However, time and time again we see common sense and women's rights discarded for the benefit of pseudoscience and men's comfort. In addition, the mere possibility of being persecuted has a sinister chilling effect on freedom of speech and expression.

Beyond norwegian borders
Norway has been extraordinary eager to implement the concept of "gendered identities" into law according to the demands posed by international lobbyists, in particular the demands stated in the Yogyakarta principles. These demands are posed in most countries. The development of such laws in Norway, the application of such laws and the outcome of the investigation against me is therefore relevant beyond norwegian borders.
