In September, LI Clean Air Water & Soil ("CAWS") and residents from the north and south shores retained the services of Teresa Butler, Esq. to bring an Article 78 ("Ratepayer Article 78") Proceeding in the Albany Supreme Court against the Public Service Commission ("PSC")and New York American Water ("NYAW"), appealing the PSC May 18 Rate Order that established our high rates. Our main argument was that NYAW and the PSC were unable and/or unwilling to substantiate that the property taxes that NYAW reported to the PSC were accurate. The PSC Administrative Law Judges denied all CAWS' questions regarding back taxes at a 9-hr hearing in Albany and CAWS' interrogatories and discovery requests.
As it turns out, NYAW submitted fraudulent tax amounts to the PSC and covered it up in what is becoming known as New York American Water-Gate cover-up of NYAW's greed and ineptitude, which cost Sea Cliff ratepayers over $2 million. Ms. Butler is requesting the Albany District Attorney to investigate NYAW's suspected perjured testimony to CAWS' questions regarding past property taxes.
The Ratepayers Article 78 is ongoing.
Thanks to your support, we raised $7,000 for attorney fees. We now need $3,000 more to bring our lawsuit to a successful conclusion.
Our arguments are strong. The PSC is commissioned to ensure just and reasonable rates. The PSC failed to do its job. This proves once and for all that the PSC is incapable of protecting the public from NYAW's greed and ineptitude. The solution is simple and has never been more apparent. We need public water now.
