Unfair legal fees in Portugal

Help a British victim of real-estate scam in Portugal

I am a victim of an international real-estate scam involving three lawyers, a real-estate company, a bank and Court of Faro in Portugal.

I need your help to raise £7500 by 25th Sep 2018.

In 2006 I purchased an apartment at Clube Oceano  from Instant Access Properties for investment purposes.  They predicted great profits and promised a stress-free investment.  They soon went bankrupt and their owner, Jim Moore is facing jail sentence in USA .

The people responsible for selling and managing my apartment at Clube Oceano are still around and have been a nightmare to work with over the past ten years.

Dozens of frustrated British investors created Clube Oceano Owners Group [COOG] in 2010, who have helped to manage the rental of my apartment to tourists by Staroteis and chased them regularly for monthly payments.

When purchasing my apartment at Clube Oceano in 2006, I obtained a mortgage from BANIF bank, who subsequently went bust and were taken over by Santander.  All my BANIF accounts were supposed to be automatically switched over to Santander.

Staroteis have been transferring my monthly payments to Santander and I travelled to Albufeira in Dec 2017 to meet Santander, who confirmed that the monies have been received safely into my account.  Therefore, I am completely up-to-date with all my mortgage payments and have a small surplus left over in my account.

Everything should be fine, so, where's the problem?

For some reason, the lawyer working for Santander is claiming that my mortgage is not up-to-date and has demanded the lawyer at Court of Faro to forcibly sell off my apartment at an auction.  I hired a Portuguese lawyer in 2015 to safeguard my interest and paid €1000 fees upfront as requested.  However, for some reason he has failed to do so and is now insisting that I have to pay £7500 to the other two lawyers first.

Why?  I haven't done anything wrong!!  Nevertheless, I agreed to re-mortgage my apartment as a way forward, but I’ve been informed by my solicitor that Santander have refused to do that.  Why?  They have created this problem in the first place, should they not be helping their client?

I have already written to The Court Of Faro in Dec 2017, hoping that she would ensure that justice was done here, but never heard anything back from the individual!

Why?  Does she not care about justice being served at Court Of Faro?

This feels as like a scam involving three Portuguese lawyers, the Court of Faro, Santander Bank and Staroteis.  I have no idea why my apartment is being forcibly sold off by auction and I cannot afford to pay £7500 unfair charges for the Solicitors working for Santander and the courts.  I do not know why Santander is not doing anything to help me and why they are allowing these lawyers to make unfair demands for money and threatening to sell off my apartment unless I pay immediately.  It feels like a scam involving blackmail!
