NAICKER family needs help!

Dear Family and Friends,

I am Vishaya Naidoo and a relative of the Naicker Family. I need your urgent help and support for my cousin Lavania Naicker, her husband and three children ( 2 of whom are in their early 20s and the youngest is 12 years old), who are facing a dire situation of having to leave Canada, which was home to them these past 4years, by Monday Oct 25, 2021.

The family is devastated, financially unprepared and desperate for help and support as they recently received the notice from Canadian government authorities to leave the country as they do not meet the criteria for Refugee status. The Naicker family are originally from South Africa and arrived in Canada in 2017 for a new lease of life following some traumatic and unfortunate circumstances that forced them to leave their country of origin. 

What actually happened?

While living in South Africa, Lavania's older daughter was physically abused by a relative and was traumatized by the experience. When Lavania and her husband tried to get justice for their daughter, the relative's family not only denied any wrongdoing, but covered it up and threatened to harm the Naicker Family with death threats and eviction. Not being able to find justice and to avoid further trauma for their daughter, the Naicker family wanted to leave South Africa and make their way to Canada where they had other family members. Unfortunately and unknowingly, the Naicker family paid a hefty sum to a fraud Immigration consultant who had promised them that they would be eligible for refugee status in Canada in view of their circumstances.

When they arrived in Canada in 2017, the Immigration Consultant had referred them to an Immigration Lawyer who would purportedly assist them with the application for Refugee status. Fortunately, for the Naicker Family, the Canadian government permitted them to find work while waiting for paperwork to be approved. The adults in the family found work to support the household while the youngest went to elementary school. Unbeknownst to them, the Immigration Lawyer too was engaged in fraudulent practices and gouged  large sums of money from the Naickers’ over time , with a promise to obtain refugee status followed by permanent residency in Canada. The lawyer had at no time disclosed to the Naickers’ that South Africa is not one of the countries in the Refugee Settlement program list for Canada. This led to unnecessary delays and further legal fees and financial burden for the family to explore other options of obtaining permanent residency status in Canada.

Sadly, the Naickers’ are not the only ones who had fallen into the wrong hands. This lawyer is currently suspended and disbarred from practicing.

What's Next for the Naicker Family?

Unfortunately, there is not enough time to proceed with an alternative route at this time and the family must honour the government's order to leave the country no later than Monday Oct 25th. Cousin Lavania and family deeply regret not consulting the right authorities prior to making arrangements to arrive in Canada and having unwittingly fallen into the hands of frauds making false promises. They are remorseful of their error in judgement. But, they are utterly grateful to Canada for allowing them to make Canada home these past few years while they were sorting out the legal paperwork for residence. It is their hope that one day in the future, Canada will welcome them back to live here permanently. 

With heavy hearts, the Naicker family will leave Canada, a place that has so quickly become their home. The youngest does not remember her friends, family, and life in South Africa. My cousin's health status puts her in a vulnerable position. She has diabetes, high blood pressure and is at high risk of contracting COVID-19 and suffering further complications. Once in South Africa, she will not be able to afford the health care that she had enjoyed here  in Canada.

The older daughter will be returning to all the trauma that she has been working through since being in Canada. Here, she had the help of a psychologist who helped her navigate through her past and heal from the abuse she suffered.

The family runs a substantial risk for poverty and homelessness when they return to South Africa. Due to recent socio-economic downturn and an uptick in crime and social unrest, much of the city’s infrastructure has been destroyed. It will be extremely difficult for this family to find its bearings again. They are very likely going to return to a life of unemployment, poverty and homelessness with little or no support from the estranged relatives there.

The family is incredibly grateful that they were able to call Canada home and pray that they will be able to do so again. The Naicker family appreciates Canada as one of the finest countries, if not the best in the world, to raise their children and where a family like theirs can thrive and support the economy.
