Help Stop This Injustice

I am the attorney on the case featured in the article below. This case involves incredible DHS incompetency compounded by a court where five out of the six judges in the county for reasons that cannot be explained have failed to protect these kids. Once DHS got off on the wrong track of blaming the mother, they continued to "unsubstantiate" over 20 hotline calls from mandated reporters despite the evidence or the source. We were finally able to get the case into court after three years where expert-after-expert testified over five days that the children had been sexually abused by their father. After acknowledging the abuse and the father as the perpetrator, the judge gave guardianship of the children to the abuser's mother, who he lives with, and made the initial order temporary so it could not be appealed.

The judge recently entered an order giving permanent guardianship to the alleged abuser's mother (who he lives with) so we now have a final order that can be appealed. On top of the $8,300 we have already paid for the trial transcript, we will need $1,958 for the record and $1,300 for the last hearing transcript, and then we will need at least another $10,000 to pay for the 20 copies of a multi-part brief that will be filed with the appellate court.

This appeal may be the last and only hope for these children. In addition to getting them away from their abuser, our long-term goal is to get legislation passed where family court judges must refer credible allegations of abuse for prosecution when it surfaces in a family court case. Only in family court does a pedophile get court ordered visitation or custody of their victim(s).
