STOP FORCED ANNEXATION IN TEXAS

Hello friends and neighbors. Well, the city of Joshua,TX is going to annex our area on December 21, 2017, when they have the next city council vote to annex. They already tried once and failed last July and now they want a second bite at the apple.  They could care less how we feel about preserving our country lifestyles.  Taxation without representation cannot succeed in the USA.  The city council and mayor will easily pass the annexation this time. They have twisted the arms of the other city coucil members who voted against annexation and now they have the votes.  We haven’t given up the fight. As a matter of fact, we have hired an attorney who is going to represent us and fight to preserve our land use rights and Joshua’s attempt to tax us without representation through forced annexation. The attorney, Jeffrey Davis (Contact his Cleburne, TX office) feels we have a pretty good case to get a temporary restraining order (TRO) against the city of Joshua and we will file a lawsuit asking a Johnson County court to preserve our rights under the new SB6 legislation passed this past summer and signed by governor Abbott, which gives us new property rights and avenues to fight Joshua. This law goes into effect December 1st, 2017 and we will file the lawsuit shortly thereafter. The attorney plans to stop Joshua from going forward with this annexation with the TRO and sue to enjoin our rights under the new SB6 law which provides for mechanisms to change our county status and seek protection from forced annexation. It’s going to involve some serious legwork, but we’re taking on this task, which will involve the following. WE WILL NEED YOUR HELP!!

We are going to do a legal petition to change Johnson County’s status under Senate Bill 6 (SB6) from a tier one county to a tier two county. Being a tier two county will give us many more rights under the new laws and will protect us indefinitely from forced annexation if we succeed. In order to do this, we will have to gather signatures from REGISTERED VOTERS ONLY who reside anywhere in Johnson County. There are 91 thousand registered voters (close approximation) and we will need 10% of those to sign our petition in order to get it on the ballot for the next general election in November 2018. We intend to gather 12 thousand signatures (not electronic) in order to allow for any errors and invalid signatures. This will ensure we get it on the ballot and let the voters decide whether or not we get to retain our property rights and can reject FORCED ANNEXATION, via the mechanisms that we will be protected by under SB6, which allows us to change our status to a tier two county via the ballot box. We will be asking the judge to give us the time required to complete our petition and get our county status changed under the new law’s guidelines. Our target is to get it on the ballot for Next November. This can be done with help from neighbors and friends. We have obtained the voter roles for Johnson County already and are currently working on setting up areas for people to work in to get signatures. We need 2500 signatures in the next two weeks to present to the judge to show we are serious and there is support from the community for this effort. Then we will get the rest over the next several months. If you can volunteer to help….Awesome. We also need help to cover the costs. (As a quick side note; changing to a tier two county will have no other impact to residents of Johnson County except as provided for under the SB6 legislation, which deals with forced annexation. It is “law specific.”)
Additionally, the attorney has advised that NOBODY sign and turn in the “Development Agreement.” In his opinion this is nothing more than you agreeing to be annexed. In effect, giving your permission for them to annex via this tricky back door agreement. If you have already signed, then send a certified letter to the city of Joshua simply stating you are rescinding your development agreement. If you have not signed, then don’t. That’s the legal advice from our attorney and a few other lawyers who have been consulted recently. We know this is a scary proposition, but we must put our collective feet down and say NO to Joshua, loud and clear. This is the best way to do that as a group.

My wife and I put up $8,000 dollars today, Wednesday, November 29, 2017 for the attorney fees. We are confident we can win and it will benefit all of us in the proposed areas for annexation. We can’t afford to bear this financial burden on our own and need your donations “FOR THE CAUSE.” If you feel this is a worthy cause to protect your land use rights, avoid city taxes and city code enforcement virtually forever then please donate what you can. You can mail a check, money order, use Paypal or cash (will give a receipt) in order to help us pay for the attorney. I will attach the receipt for what we paid the attorney today on the last page of this bulletin. We know some of you can’t afford to pay, while others can afford more so keep that in mind, but if each person in the proposed areas for annexation donated $75 to $100 dollars, then that would cover 90% of attorney fee paid upfront today.

Our attorney, Mr. Davis has stated, “this is going to be a precedent setting, landmark case” under the new SB6 legislation passed in the summer special session. He is going to do press releases and bring a lot of media attention to our “fight.” There will be many people following closely to see if we succeed. We are also going to need donations for advertising once we get this item on the ballot. Cities (like Joshua) aren’t going to like what we are doing and we must be prepared to fight back any negative media or advertising they do once the election nears, so we ask any and all PATRIOTS to donate to our cause and help us fight the good fight. They say you “can’t fight city hall,” but you can if people are willing to stand up and fight for your rights.  This is going to be a LANDMARK, PRECEDENT SETTING CASE UNDER THE NEWLY PASSED TEXAS LEGISLATION REGARDING FORCED ANNEXATION.  IT'S GOING TO GET LOTS OF ATTENTION FROM FELLOW CITIZENS WHO DON'T WANT TO BE ANNEXED AND IT'S GOING TO BE STRONGLY OPPOSED BY SMALLER CITIES WHO WANT TO GRAB YOUR RURAL AREAS INTO THE CITY LIMITS AGAINST YOUR WILL.
