Support Vunerable Tenants Supreme Court Fight

Support for 10 vulnerable retirees in their fight for justice in the Supreme Court      Update on Gofundme page Thank you to those who have already supported our Gofundme campaign. All funds raised will help a group of 10 elderly residents continue their fight for justice. As mentioned above, these 10 residents are dealing with proceedings in the Supreme Court. The 10 properties were mortgaged by Sterling First group to a separate corporation, Commco Super Pt Ltd. Following the collapse of Sterling First, Commco Super is now claiming that it is not bound by the leases and is seeking to force the tenants out of their homes. As we outlined above, the liquidators of the Sterling First Group may have documents that could assist with the case.   They have however asked that we issue a subpoena to compel them to supply those documents and also cover their internal administration costs and potentially their legal costs too.  After losing all of their life savings in this failed scheme, this is money that this group of 10 residents just don't have.   We want to emphasise that this is not to pay our own legal costs.  We are extremely grateful to our Lawyers who are acting for us completely pro bono (for free), however more help is needed in our fight for justice.   The funds raised in this Gofundme campaign will cover the third-party costs which are necessary to take our case forward. Any assistance is greatly appreciated. Thank you again for your support.         The WA group, Sterling First operated a retirement housing program called Sterling New Life. The program was designed to give seniors peace of mind and housing security with long term leases. Unfortunately the company collapsed and went into administration in May 2019 leaving over 100 senior tenants who paid up front lease costs devastated . To make matters worse, the Responsible Entity of the Sterling Income Trust (or SIT) (Theta Asset Management) which oversaw the management of the SIT fund for about 60 seniors also went into administration in December 2019 and is now in liquidation. Over $10m in seniors life savings gone. Due to the collapse of Sterling First Group, rental payments to the landlords have stopped, forcing many landlords to start the eviction processes of their Sterling New Life tenants. Many of the senior have already faced eviction hearings in the Magistrates Courts and so far have had their cases deferred to a later date but there is a group of 10 seniors who are now dealing with proceedings in the Supreme Court. Causing additional stress to seniors who for some already have health issues. We are extremely grateful to our Lawyers who are acting on a Pro Bono basis, however more help is needed. The liquidators of the Sterling First Group may have documents that will assist our case. Which means, the seniors will have to bear that cost which is money that they don't have. We are launching this Gofundme to ask for help with these third party costs which are necessary to take our case forward.
