Dear family, friends and good samaritan's, we NEED your help!
We hate that it has come to this, but, we are asking for any and all donations to help us right an injustice (Legally) that happened in our close knit community illegally.
We are neighbors and have lived here for 40-60 years and cared for each other through good times and bad. I can't even begin to tell you how wonderful it is to have neighbors who have stuck together through hurricanes, house fires and much more, always being there for each other. Neighbors you can always count on!
For over 50 years, the people in this community have enjoyed our local Neuse River, via the right of way at the end of our road.
Recently someone bought a piece of property on the Neuse river, BESIDE our right of way to the river and he now claims that he owns it. This is NOT the case per our Craven County Commissioners-who have stated, we still have the right to go down to the river. Senator Sanderson's office even sent a NCDOT engineer to measure and advise the Senator on the plats. Per the e-mail from the Senator's office concerning the right of way," the property does not belong to the NC Department of Transportation, nor do they believe that it is the adjoining land owners exclusive property" and we need to consult with a land use attorney or real estate attorney, as they are not attorneys. This is why we're here.
We are asking for and need help with this. We are a middle class community who have worked hard all of our lives, as you have. Generation after generation has used this right of way, from parents taking their children, grandchildren down to the river to teach them how to swim, fish, crab, and enjoy the wild life. Even a young man who had his first kiss with his future wife on the river at the end of our road, have been married now for almost 40 years! Until this happened, families and couples still walked down and enjoyed the wonderful, beautiful, largest river east of the Mississippi.
At first he tried to put up a fence to block it and found out neighbors were not happy about that. Several of us went to the end of the road to speak to him about it. He was having it taken down at that point and in speaking to him, he stated "he did not want to cause any consternation with his neighbors and if anything he would make it nicer for us to enjoy".
Less than a month later, he had dirt delivered to the end or our road which was piled 6-8 ft high, so you could no longer see the river from the road.
One month later he was threatening to call the Sheriff's department and have a couple arrested for trespassing. These folks were the ones who had investigated the rights of the end of our road, who had spoken to our county commissioners, and started the save our Riverview heights campaign.
Several of us when called went down to show solidarity and waited for the Sheriff's dept. After speaking with us and him, we were told that this is a civil issue not a criminal issue and he was told to go to the magistrates office to swear out warrants against us and that we could do the same if we needed too.
When asked by a neighbor to just show us that he owned the land, he said " I don't have to show you anything, you are not a lawyer, you are not a judge, you are nothing but a trespasser". After this incedent, he proceeded to put the fence back up.
We have to fight this! This man is a previous political figure and a lawyer. We are asking for what seems like a lot in donations I know. It costs $3000.00 up front fees for the lawyer we have spoken too, plus a $300.00 an hour.
