We are seeking some initial legal advice, and if this where to progress we would require the money for legal fees, this is what any donations would be used for.

Where is your money going? 
 - £154 is the Application fee
- £770 is the Fee for the initial JR hearing
- £5000 - Costs if the JR proceeds are capped at this

This is why we have set a target of £7000

This Campaign (Save Bixteth Park)  brings together local groups, (Save Bixteth Gardens, Liverpool CPRE, Friends of the Parkland) as well as several residents (Bixteth Street Residents, Hamilton House Residents, Princes Gardens Residents Assoc) and other local interest groups so we can all work together in any legal action.

We want to bring together everyone who cares about the future of Bixteth Gardens/Park, Pall Mall and the Area, and this is the best way to do it.

Some Details about the site from Save Bixteth Street Gardens

A small sanctuary in the heart of the city, Bixteth Street Gardens is the last remaining green space in Liverpool's commercial district. Frequented by local residents, workers and dog walkers, not to mention the extensive animal population of birds, bats, bees, squirrels and rabbits, this space is also home to 61 large, mature trees.

This thriving community space is in danger of being lost forever as Liverpool City Council along with CTP and Kier Property, plan to destroy and redevelop the area. With the proposal of four new multi-storey buildings and allocated "public realm" intended for the site, the current green space will be cut by a third. This is, of course, if the development even materialises - all that is currently being pushed though is the complete reclamation of the land.

We need your help to demonstrate that the people of Liverpool matter and that our opinions count. Hundreds of city centre homes are currently being developed in the area; they want people to buy into the urban lifestyle and live in the city centre, yet no consideration has been given to the quality of this lifestyle - the mounting evidence of the health implications of the eradication of urban green space is indisputable.

Sadly we were let down by a mixture of lawyers and finances, in that the barrister who initially offered to take on the matter on a pro bono basis, then decided he wanted paying. In normal circumstances we would have looked elsewhere, but we only had 3 days to go to the deadline and the bulk of the £1,690 raised would have gone by the time of the first hearing in Court fees, counsel's fees and costs, leaving us open to being liable to upto £5,000 in Costs at the final hearing, apart from further Court and lawyers' fees.

The main practical obstacle was that the City Council refused to provide an assurance that trees would not be felled whilst we were awaiting a Court hearing - as well as the fact that even if we had succeeded, they could merely have applied again and they indicated they would have done so.

We are still pursuing the matter with the Local Govt Ombudsman - as the City Council have not disputed non-notification of neighbours - and we have also asked the Sec of State to exercise his exceptional power to revoke the decision.

As we no longer have cause to use funds, we have taken the decision to refund all donations.

We ask that perhaps you donate this money to one of the ongoing campaigns in the Liverpool area, that are trying to succeed where we failed, or perhaps donate it to animal welfare.

We are restricted as to what we can say publicly, but we have now been advised by three lawyers that our case has merit. So the only obstacle which may prevent us from continuing is a lack of funds to pay Court application fees and lawyers, we again ask you to share, tweet and spread this far and wide.

Remediation = Destruction! WE NEED MORE FUNDS!

Although we are very restricted as to what we can say, after taking further legal advice we have been advised that our case has merit! This is good news!

However, in order to challenge the City Council in Court, we need to be able to be sure we can pay Court fees and lawyers. It would be awful to think that the only reason we couldn't stop the destruction of our park was due to a lack of funds.

So, can we please, please ask you all to consider giving £5+ (this is the minimum donation on gofundme) to help save the only public open space in the heart of the city, to protect the rights of way and to save the 61 trees and wildlife that currently call the park home.

OVER £1000 Donated So Far!

We can't thank those who have donated enough, work has 'started' in the last few days, but rest assured we are not stopping, and we are hoping that the work we are doing will stop any destructive work from happening.

As this is a legal process we will be limited to what we can and can't say, so apologies we can't give a more detailed update.

We are sharing some heartbreaking images shown on twitter in the last few days of the Park in all it's glory and the impact of what the contractors have done so far.

We are assured this can all be REVERSED, and we will continue to work to do this.

But again we need more help, we still have a long way to go to reach our £6000 target, so we need you to share, we need more donations, £5 is the minimum but feel free to club together with any spare change you might have.
