<div>Wir sind Stadt Sucht Leben (SSL), eine Wohngemeinschaft von 13 Personen, die im vierten Stock der H48 leben, einem alten Fabrikgebäude in Neukölln (@H48bleibt auf sozialen Medien). Wir rufen zu finanzieller Unterstützung auf, denn wie ihr vielleicht schon gehört habt, haben unsere Vermieter allen rund 60 Bewohnern unseres Gebäudes kürzlich die Kündigung ausgesprochen. Sie wollen, dass wir unser Zuhause bis zum 31. Oktober 2024 verlassen, damit sie unsere Wohnzimmer, Schlafzimmer und Küchen als Büros mit „industriellem Charme“ vermieten können – aber wir können und werden kämpfen!

<div>We are Stadt Sucht Leben (SSL), a shared flat of 13 people living together on the fourth floor of H48, an old factory building in Neukolln (H48bleibt on social media). We are calling for financial support because, as you may have heard, our entire building of around 60 people recently received cancellations of our contracts by our landlords. They want us to leave our home by 31 October, so that they can rent out our living rooms, bedrooms, and kitchens as offices with “industrial charm” - but we can and will fight back!

<div><strong>We will fight for our tenancy rights in court to resist the termination of our contracts</strong>. These court cases are associated with financial risks that we need to spread across as many shoulders as possible in solidarity.

<div><em>Wer sind wir (und warum sollte es euch kümmern)?</em>

<div>Wir sind jung und alt, wir verbringen Zeit miteinander, studieren, arbeiten, essen, schauen Filme, treiben Sport, machen Musik. Wir sind Menschen mit und ohne deutschen Pass, einige sprechen Deutsch, andere nicht, einige sind vom Grenzregime betroffen, andere nicht. Menschen, die sich im Rollstuhl fortbewegen und mit Assistenz leben, Menschen, die seit 20 Jahren in Berlin leben, und andere, die gerade erst angekommen sind. Alle zwei Wochen halten wir ein Plenum ab, wir teilen unser Essen und unterstützen einander in persönlichen, politischen und bürokratischen Angelegenheiten. Wir sind weit mehr als nur eine Gruppe von Menschen, die irgendwo leben möchten, auch wenn wir das natürlich auch sind. Unsere WG ist ein Ort, an dem wir viel lernen, oft herausgefordert werden und unsere politischen Ideale in die Praxis umsetzen können.

<div>Auf persönlicher Ebene wäre der Verlust unseres Zuhauses tragisch, aber der Schaden für unsere Stadt und unser Viertel durch den Verlust der H48 wäre noch größer. Menschen leben seit den 80er/90er Jahren in dem Fabrikgebäude in Gemeinschaftswohnungen wie unserer. Es ist einer der wenigen Orte, der so dynamisches und robustes gemeinschaftliches Leben ermöglicht, sowie einen Projektraum für politische Organisation, Veranstaltungen und Ausstellungen. H48 hat uns allen, die dieses Zuhause hatten, gezeigt, wie sehr sich unser Leben verändert, wenn wir in einer echten Gemeinschaft leben. Es ist nicht das erste Mal, dass unser Haus in Gefahr ist. <div>Die Räumung unseres Zuhauses betrifft mehr als nur die Menschen, die darin leben: Sie steht für die fortlaufenden Veränderungen in unserem ganzen Viertel und unserer Stadt. Weltweit sind Städte, die einst Bewegungen des politischen Wandels förderten und künstlerische Innovationen antrieben, nur noch Schatten ihrer selbst. Nun verliert auch Berlin, eine Stadt, die lange Zeit für das Brechen dieser gesellschaftlichen Norm der Isolation stand und wo Generationen von Aktivisten lange für Gebäude kämpften, die echte und autonome Gemeinschaften beherbergen, sein Herz und seine Seele. Räume wie unsere WG und unser Gebäude werden ausradiert. Gleichzeitig hat sich die ohnehin prekäre Mietlage in Berlin, und besonders in unserem Viertel Neukölln, in den letzten zwei Jahren massiv verschlechtert. Und jetzt steht H48, einer der wenigen bezahlbaren Orte, auf der Abschussliste. Die ersten Wohnungen wurden bereits vor einigen Jahren geräumt und stehen seitdem leer, in einem der begehrtesten Viertel der Stadt. Das darf uns nicht passieren!

<div><em>Warum bitten wir um eure Unterstützung?</em>

<div>Wir müssen vor Gericht ziehen, um für unser Recht auf unser Zuhause und unsere Stadt zu kämpfen! Der Kern unseres Rechtsfalls ist, dass, obwohl Menschen seit den späten 90ern in unserer WG leben, die Verträge nie von gewerblicher auf Wohnnutzung umgestellt wurden. Es ist viel schwieriger, Mieter mit Wohnmietverträgen zu kündigen, während gewerbliche Mietverträge jederzeit gekündigt werden können. Es ist auch illegal, Wohnräume in Büros umzuwandeln, wie es unser Vermieter versucht.

<div>Glücklicherweise erlaubt das deutsche Gesetz eine gewisse Flexibilität, wenn es darum geht, was auf dem Papier steht im Vergleich zu dem, was in der Realität praktiziert wird – was bedeutet, dass wir die Chance haben, „zu beweisen“, dass dies tatsächlich unser Zuhause ist und es seit Jahrzehnten war (Feststellung). Dies kann mehrere Jahre dauern, aber wir haben Dokumentationen und Bezeugende, die Generationen zurückreichen, auf unserer Seite.

<div>Wir sind optimistisch, was unsere Chancen angeht, und haben ein starkes Anwaltsteam, das seit Jahren in unserem Namen kämpft. Diese Gerichtsprozesse sind jedoch mit finanziellen Risiken verbunden, die wir auf möglichst viele solidarische Schultern verteilen müssen.

<div><em>Who are we (and why should you care)?</em>

<div>We are younger and older, we hang out, study, work, eat, watch movies, play sports, make music. We are people with and without a German passport, some who speak German and some who don’t. People who move around in wheelchairs and live with assistance, people who have been in Berlin for 20 years and others who have just arrived. We have a plenum every two weeks, we share all our food, and we support one another with our personal, political, and bureaucratic struggles. We are much more than just a bunch of people who want to live somewhere, even if we are that, too. Our flat is a place where we learn a lot, are challenged a lot, and can put our political ideals into practice.

<div>On a personal level, to lose our home would be tragic, but the damage to our city and neighborhood caused by the loss of H48 would be even greater. People have lived in the factory building in communal flats like ours since the 80s/90s. It is one of the few places left that gives home to such dynamic and robust community living, as well as a project room for political organization, events, and exhibitions. H48 has taught all of us who have called this place home how our lives take on a vastly different meaning when we live in a real community. <div>The eviction of our home impacts more than just the people living in it: it represents the ongoing changes in our whole neighborhood and city. All over the world, cities that once upon a time fueled movements of political change and encouraged artistic innovation have become shadows of what they once were. Now Berlin, a city that has long stood for the breaking of this societal norm of isolation, where generations of activists have long fought for buildings that house real and autonomous communities, is also losing its heart and soul. Spaces like our flat and building are being eradicated. Meanwhile, the already precarious rental situation in Berlin, and especially in our neighborhood of Neukolln, has worsened massively in the last two years. And now H48, one of the few affordable places left, is on the chopping block. The first flats were already evicted several years ago and have stood empty ever since, in one of the most desired neighborhoods in the city. We can’t let this happen to ours!

<div><em>Why are we asking for your support?</em>

<div>We are planning to go to court to fight for our right to our home and our city! The crux of our legal case is that, while people have lived in our flat since the late 90s, the contracts were never changed from commercial to residential use. It is much more difficult to evict tenants with residential leases, whereas commercial leases can be canceled at any time every three to six months. It is also illegal to turn living spaces into offices, as our landlord is trying to do.

<div>Luckily, German law allows for some flexibility when it comes to what is written on paper versus what is practiced in reality - meaning that we have the chance to “prove” that this is indeed our home and has been for decades (Feststellung). This may take several years, but we have generations worth of documentation and witnesses on our side.

<div>We feel optimistic about our chances and have a strong legal team that has been fighting on our behalf for years. However, these court cases are associated with financial risks, which we need to spread across as many shoulders in solidarity as possible.
