<div>Mijn naam is Ben van den Dungen, Ik ben lid van de kunstenbond en tezamen met Ellister van der Molen willen we een rechtszaak beginnen tegen de Kunstenbond om ons recht te halen over een ernstig conflict binnen de organisatie teneinde de belangen voor de muzieksectie binnen de sector en jouw belangen veilig te stellen. Het totale budget wat we nodig hebben ligt rond de 13000 euro. Intern hebben we al 5500 euro opgehaald maar we hebben nog 7500 euro nodig. Dit bedrag wordt aangewend om de kosten van de advocaat en de administratieve kosten van de rechtbank te betalen. Naast onze interne inzamelingsactie zijn we deze actie begonnen om iedereen in de sector te bereiken en om het totale budget te verkrijgen doen we tevens op deze manier een beroep op jullie.

<div>Het verhaal achter deze actie.
</div>
<div>De Kunstenbond – en daarmee ook de belangenbehartiging van musici – verkeert in een diepe crisis, nadat is gebleken dat de directie zonder expliciete goedkeuring van bestuur en ledenraad de begroting fors heeft overschreden. In plaats van het begrote exploitatie tekort van €600.000 boekte de vereniging een exploitatietekort van ruim €1,1 miljoen. Geld van de leden.

<div>Afgelopen maandag zijn wij – Ben van den Dungen en Ellister van der Molen, bestuursleden namens de vakgroep Muziek/Ntb – door de Ledenraad van de Kunstenbond ontslagen met een nipte meerderheid (7–6). Dit gebeurde terwijl wij ons in het buitenland bevonden vanwege eerder gemelde werkverplichtingen, waardoor wij niet aanwezig konden zijn en van hoor en wederhoor geen sprake was.

<div>Onze ‘fout’? Kritische vragen stellen over het financiële beleid, de rapportages, en het gebrek aan transparante besluitvorming.

<div>Wij zijn ervan overtuigd dat dit niet alleen ons persoonlijk treft, maar raakt aan de kernwaarden van de Kunstenbond: democratisch bestuur, ruimte voor kritische inbreng en verantwoord financieel beleid. Daar hebben wij ons steeds voor ingezet – in het belang van alle leden, van een goed vertegenwoordigde achterban, en van duurzame samenwerking met verschillende partners binnen de culturele sector.

<div>Wij kunnen en willen dit ontslag niet zomaar laten passeren. We bereiden een kort geding voor (en mogelijk een vervolgprocedure), waarin wij:

<div>het ontslagbesluit willen laten toetsen op zorgvuldigheid en rechtmatigheid;
</div>
<div>misstanden in bestuurscultuur en informatievoorziening aan de orde stellen; en een krachtig signaal willen afgeven dat kritische inbreng in een vereniging geen reden mag zijn voor verwijdering.

<div>Zo’n procedure brengt kosten met zich mee: juridische bijstand, griffiekosten, en eventuele proceskosten. Als werkzame musici/zzp’ers kunnen wij die niet alleen dragen. Daarom vragen wij iedereen die zich betrokken voelt bij een eerlijke, open Kunstenbond om een bijdrage van €10 /€15 /€20 / € 25/ €30/ €40/ €50 (of wat je kunt missen).

<div>Dit gaat alle kunstenaars aan die zijn aangesloten of niet aangesloten bij de

<div>Kunstenbond en die willen dat deze organisatie democratisch werkt , een zuivere governance betracht, een gezonde financieel beleid voert en daardoor beter voor de belangen van de

<div>leden kan opkomen.

<div>Wat gaan wij doen!
</div>
<div>Wij gaan een rechtszaak aanspannen tegen de Kunstenbond om wat hierboven is vermeld af te dwingen. Via deze site en via de social media en de pers zullen we jullie op de hoogte houden.. We gaan de zaak starten als we het bedrag binnen hebben en.verwachten dan dat het daarna zo’n vier a vijf weken kan gaan duren dat er een uitspraak is van de rechter .

<div>Elke bijdrage – groot of klein – helpt. Als de werkelijke kosten lager uitvallen of bij een eventuele kostenvergoeding, zullen giften uiteraard naar rato worden teruggestort of – in overleg – gedoneerd aan een transparant doel binnen de sector.

<div>My name is Ben van den Dungen. I'm a member of the Arts Union, and together with the music section, we want to file a lawsuit against the Arts Union to assert our rights regarding a serious conflict within the organization. This lawsuit will protect the interests of the music section within the sector, as well as yours. We need a total budget of around €13,000. We've already raised €5,500 internally, but we still need €7,500. This amount will be used to cover legal fees and the administrative costs of the court. In addition to our internal fundraising campaign, we've launched this campaign to reach everyone in the sector, and we're asking for your support to raise the total budget.

<div>The story behind this action.
</div>
<div>The Kunstenbond (artists' union) — and with it, the advocacy for musicians — is in deep crisis after it emerged that the management significantly exceeded its budget without the explicit approval of the board and members' council. Instead of the budgeted deficit of €600,000, the association posted an operating deficit of over €1.1 million. This was the members' money.

<div>Last Monday, we — Ben van den Dungen and Ellister van der Molen, board members representing the Music/Ntb department — were dismissed by the Members' Council of the Kunstenbond by a narrow majority (7-6). This happened while we were abroad due to previously reported work commitments, preventing us from being present and preventing us from being heard.

<div>Our "mistake"? Raising critical questions about the financial policy, the reporting, and the lack of transparent decision-making. We are convinced that this not only affects us personally, but also touches on the core values of the Kunstenbond: democratic governance, room for critical input, and responsible financial policy. We have always strived for this – in the interest of all members, a well-represented constituency, and sustainable collaboration with, among others, BIMpro and other partners within the cultural sector.

<div>We cannot and will not let this dismissal simply pass. We are preparing summary proceedings (and possibly follow-up proceedings), in which we:

<div>want the dismissal decision to be reviewed for due care and legality;
</div>
<div>address irregularities in governance culture and information provision;
</div>
<div>and want to send a strong message that critical input within an association should not be grounds for removal.

<div>Who is this action intended for?
</div>
<div>This concerns all artists affiliated with or without the Kunstenbond (Arts Union) and who want this organization to operate democratically, maintain sound governance, pursue a sound financial policy, and thus better represent the interests of its members.

<div>What are we going to do?
</div>
<div>We are going to file a lawsuit against the Kunstenbond to enforce the above. We will keep you informed via this website, social media, and the press. We will initiate the case once we have received the required funds, and we expect it to take approximately four to five weeks for a court ruling.

<div>We ask for your help in this matter.

<div>Such a procedure entails costs: legal assistance, court fees, and potential litigation costs. As working musicians/self-employed professionals, we cannot bear these costs alone. That's why we're asking everyone who cares about a fair, open Kunstenbond (Arts Union) to make a contribution of between €10 and €50 (or whatever you can spare).
