<div>Die Bloggerin M. hatte in einem „X“-Tweet am 18. März 2023 behauptet: „Rechtsextreme Frauen unterwandern aktuell aktiv auch die textile Hobbyszene (z.B. zum Thema Stricken). Bitte setzt euch aktiv damit auseinander, wer was anbietet und wer Angebote bietet.“

<div>Zur Verstärkung der Reichweite verwendete sie die Hashtags #PleaseRetweet und #Followpower. Der Tweet wurde 15.100-mal angezeigt. Unter ihren 4.715 „X“-Followern sind u.a. Star-Schriftstellerin Sibylle Berg, Monika Herrmann (Die Grünen), ehemalige Bürgermeisterin des Bezirks Friedrichshain-Kreuzberg, taz-Journalistin Gilda Sahebi, der Anti-Fake-News-Blog Volksverpetzer.

<div>Dieser Tweet wurde in dem aktuellen Buch „Willkommen im falschen Film“ der Kabarettistin und Bestsellerautorin Monika Gruber in dem Kapitel „Warum Nazis gerne stricken, die wirre Masche mancher Tugendwächter“ aufgegriffen ( <a href="https://www.presseportal.de/pm/130482/5694266" target="_blank" rel="noreferrer noopener"><a href="https://www.presseportal.de/pm/130482/5694266" target="_blank" class="" rel="nofollow noopener noreferrer">https://www.presseportal.de/pm/130482/5694266</a></a> ). Die Anwaltskanzlei Jan Froehlich, die M. vertritt, behauptet, dass ihre Mandantin am 22. Dezember 2023 auf das Hörbuch und damit das Buch der Autorin Frau Gruber und damit auch auf verschiedene Posts von mir auf „Facebook“ und „X“ aufmerksam geworden sei. Diese schrieb ich, weil eine Welle an Hass- und Verleumdungskommentaren, Boykottaufrufen über meine Autoren-Kollegin und Freundin Monika Gruber hereinbrach. Dafür hatten belegbar M. in Teilen selbst und ihr Wohlgesinnten durch entsprechende Kommentare und Aufrufe im Netz gesorgt. In meinen Postings habe ich meine Solidarität und Unterstützung mehrfach unterstrichen. Da viele der Aufpeitscher deutlich aus der neu-woken Gesinnungs-Diktat-Ecke stammten, die sich gegen ein hohes Gut unserer Demokratie, nämlich Kunst- und Redefreiheit aussprechen, habe ich als „jetzt erst recht“-Statement auf Monika Grubers Buch verwiesen. Ebenso habe ich auf mein aktuelles, drittes Buch „WOKE - wie eine moralisierende Minderheit unsere Demokratie bedroht“ hingewiesen, da es durch die Cancel-Culture-Angriffe gegen Monika Gruber noch mehr Relevanz erhielt.

<div>Inzwischen werde ich in zahllosen öffentlichen Postings, privaten Nachrichten mit Hass- und Verleumdungs-Botschaften sowie Boykott-Aufrufen meiner Bücher und meiner gesellschaftspolitischen Arbeit bombardiert. Dokumentiert aufgerufen hat neben M. eine wachsende Zahl von Anhängern der Bloggerin. Ein Ende ist dokumentiert nicht in Sicht. Es findet genau das gegen mich statt, was M. unberechtigt für sich reklamiert: ein öffentliches an den Pranger stellen, soziale Ausgrenzung, Stigmatisierung. Die Boykottaufrufe gefährden meine Glaubwürdigkeit und wirtschaftliche Existenz. Es findet eine öffentlich Rufmord-Kampagne durch Verleumdungen und Beleidigungen statt.

<div>In diesen Dimensionen bin ich finanziell nicht in der Lage, mich dagegen zu wehren.

<div>Ich habe eine auf Medienrecht spezialisierte Kanzlei damit beauftragt, Unterlassungserklärungen an alle Absender zu versenden, die die gesetzlichen Grenzen überschreiten. Ebenso werden auch mögliche Gegendarstellungen durchgesetzt. Auch Schadensersatz- und Schmerzensgeld-Ansprüche werden geltend gemacht.

<div>Nach einer ersten anwaltlichen Beratung kann die mir vorgeworfene schwerwiegende Persönlichkeitsrechtsverletzung nicht anerkannt werden. Die mit ihren Postings erzielten Reichweiten und die Form (Boykott-Aufrufe, an den öffentliche. Pranger stellen) sind ein eindeutiges Indiz dafür, dass M. aktiv Öffentlichkeit schafft und auch erreicht. Noch dazu fordert M. in einem dokumentierten Posting „die Medien“ dazu auf, sie sprechen zu lassen.

<div>Auch dem Vorwurf der kommerziellen Verwertung der streitgegenständlichen Äußerungen kann nicht gefolgt werden.

Please actively engage with who offers what and who provides offers." To enhance the reach, she used the hashtags #PleaseRetweet and #Followpower. The tweet was displayed 15,100 times. <div>This tweet was picked up in the current book "Willkommen im falschen Film" by comedian and bestselling author Monika Gruber in the chapter "Warum Nazis gerne stricken, die wirre Masche mancher Tugendwächter" (Why Nazis like to knit, the confused scheme of some virtue guardians). The law firm representing M. claims that their client became aware of the audiobook and thus the book by author Mrs. Gruber and also various posts of mine on "Facebook" and "X" on December 22, 2023. I wrote these because a wave of hate and defamation comments, boycott calls against my author colleague and friend Monika Gruber, were pouring in. M. and her sympathizers contributed to this with corresponding comments and calls on the internet. In my posts, I repeatedly emphasized my solidarity and support. As many of the agitators clearly came from the newly woke ideological corner that opposes a fundamental value of our democracy, namely freedom of art and speech, I referred to Monika Gruber's book as a "now more than ever" statement. I also pointed out my current, third book, "WOKE - wie eine moralisierende Minderheit unsere Demokratie bedroht" (WOKE - how a moralizing minority threatens our democracy), as it gained even more relevance due to the cancel culture attacks against Monika Gruber.

<div>I am now bombarded with countless public posts, private messages with hate and defamation messages, as well as boycott calls for my books and my socio-political work. In addition to M., a growing number of followers of the blogger have documented these calls. An end is documented not in sight. Exactly what M. falsely claims for herself is happening to me: public shaming, social exclusion, stigmatization. The boycott calls endanger my credibility and economic existence. A public character assassination campaign is taking place through slander and insults. In these dimensions, I am financially unable to defend myself against this.

<div>I have instructed a law firm specializing in media law to send cease-and-desist declarations to all senders who exceed the legal limits. Possible counterstatements are also being enforced. Claims for damages and pain and suffering are also being asserted.

<div>After initial legal advice, the alleged serious violation of personal rights cannot be recognized. The reach achieved with her postings and the form (boycott calls, putting on public display) are clear indications that M. actively creates and reaches the public. Furthermore, M. calls on "the media" to let her speak in a documented post. The accusation of the commercial exploitation of the controversial statements cannot be followed either. Therefore, the entire claim for damages and reimbursement of costs is rejected.
