Oral Hearing fund against Skerries Drive Thru

As you know last week Fingal County Council granted planning permission for a drive-thru fast food restaurant beside the Educate Together primary school in Skerries. While we in the organising committee against the driv-thru were very disappointed we were half expecting this decision as the planner we had hired had advised us that it looked like Fingal were going to grant permission.

Via our fundraising activities last year we gathered enough to allow us to make a standard appeal to An Bord Pleanala. We have €1202.69 left in the fund. The cost of a standard appeal would be as follows:

500 plus VAT @ 23% €615

So we are covered in that regard. However, the advice coming from various quarters now is telling us that to optimise our chances of overturning the decision we should pursue an Oral Hearing. This is much more expensive as if we are to do it properly and professionally, we would need our planner at the hearing each day and we would potentially need other expert witnesses too such as an engineer.

Seeing as we have gone this far and we have done everything in our power to stop the drive thru it seemed only right that we try to pursue the best option to overturn the decision. We also felt it was important to offer the people of Skerries the best chance possible to prevent the drive-thru from progressing. However, in order to be sure that we can pull this off in a professional manner we estimate that we need to raise another €5,500. Apart from the professional application cost (€845), for the planner and engineer to be prepared and at the oral hearing with their team, they have quoted €5500 but it depends on how long the hearing goes on for.  We would stress this is a loose estimate as we simply will not know the exact cost until later. 

If we raise funds that are not adequate to bring a professionally run Oral Appeal we can use to funds to help finance a few other standard appeals to An Bord Pleanala. We can also donate any surplus funds to the Skerries Community Association who have also backed this public appeal for funds for a professionally run Oral Appeal to An Bord Pleanala.

If the application for an Oral Appeal is rejected the funds raised for it will go to the Skerries Community Association once we are satisfied that they can’t be used in any other way to help block the drive-thru.

We also have a deadline to reach this figure as our application for an Oral Appeal must be submitted by April 2nd

Please spread the word and dig deep. This is our last chance to stop this unwanted development in our lovely town.
