I am raising funds to work through a large family law case I have on my hands.
When I returned from Bali my daughter asked me to smell her privates, the next day she told me she didn't want to play the game where daddy inserted _ in _ and the following day she told me that daddy licked her privates. NOV 2017
Appalled, I contacted a friend who is a therapist and she told me to call the national abuse hotline and we would be fine.
We haven't been fine! My call was treated like a false complaint. My daughter had a bruise on her ear when I returned and the teacher's assistant told me that Andrea said 'daddy dragged me'. The teacher did not report the incident.
My daughter went to a forensic interview. They told me my mom had to take her to a center over an hour away from our house. Strangers who are not particularly qualified then determined in 30 minutes that she divulged but the supervisor said I coached her.
After 60 days child protective services closed the case and then I took my daughter to a Play Therapist because we were refused counseling services from the child advocacy centers.
During February after several sessions with the Play Therapist my daughter opened up about the abuse and told the Play Therapist, her long term at home day care provider and they both called the abuse hotline and then another investigation was started.
That day a police officer and social worker came to my home, interviewed me, my daughter, and my parents. My daughter told the police and the investigator that came to my home. Its in the police report. The investigators report is missing for that day. They took pictures of my home. The social services investigation was closed in 5 days. However after calling the police at the end of May I found out the police still have an active investigation.
Since last year I have spent over 5k on attorneys and I just took out a further loan for another 5k. My father has loaned me 2.5k and is about to lend me another 2k I have spent the last two weeks interviewing attorneys because my current attorney, Joanna Mitchell Esq of Clermont, took my last 2.5k and disappeared. After multiple attempts to contact her and retrieve my file I realized I needed to hire new counsel. So I have not had an attorney and instead of preparing for our case I have spent the last week and a half between work and mom duties spending more money interviewing many attorneys.
I finally found the right attorney who knows how these cases work and can get the best case scenario for my daughter.
Family law cases are not eligible for legal aid.
Since my ex is innocent until PROVEN guilty then I have the burden to prove that he did this. The government wont do it for me. This means that witnesses must be subpoenaed and many other crucial legal tasks must take place to prove this happened by presenting the evidence correctly to the judge in order to keep my daughter safe. Until there is enough evidence uncovered it seems that he will not be held accountable for his actions against our child and if not handled correctly I could be seen as a hostile parent. It is my duty to protect my child and I have done my best with my resources.
If I do not follow through with the most qualified attorney I can find, I stand to loose time with my daughter to her abuser. I am financially at the end of my credit line and cannot afford to take more traditional loans.
I am asking my long terms friends and my family for help. I have never been in such a desperate situation.
The attorney I will hire charges 7.5k as a retainer and any money used must be replaced every 2 weeks keeping the retainer at 7.5k to continue with litigation. I have to hire an expert which will cost 2.5 to 3.5k for each person's evaluation and over 1k anytime the expert is asked to testify in court.
I will use ALL monies gathered towards legal funds. I have no idea how long or how much this will cost. Right now I only have the 7.5k to get the lawyer started but in two weeks I need to have money to cover any and all work they have done. These cases can take time and money. it all depends on how much the other party will fight against the truth.
Please help me. Anything helps. I rarely ask the people in my life for help. I will be happy to provide further information if anyone is able to help me in any other way with this situation.
