ABOUT ME

I am a regular hard working self-employed single dad with sole custody of my two children who I have raised by myself since 2012. During my spare time in Colorado, I was a volunteer first responder in Search and Rescue and many of my friends were police officers and firefighters. I have always been a law-abiding citizen obtaining all the correct permits whilst all my guns have been bought from Federal Firearms Licensed dealers. I have maintained concealed carry permits for over a decade and prior to this, my only brushes with law enforcement were, like you, turn signal violations and speeding tickets.

My youngest child, has special needs and living in a mountain town in Colorado I had to drive 4 hours for the special services he required. We decided we needed to move to New York where all these services we more accessible. We left our family home that I actually built myself as my forever dream home and rented a small apartment in the suburbs of New York. My days were spent trying to get my children acclimatized to a new school, make friends, start a business and that was before dealing with all my son's special needs requirements, doctors appointments etc. I am sure you can relate to the incredible pressure and drain doing this as a couple never mind as a single dad. Things sometimes fall through the cracks. 

WHAT HAPPENED

Not long after arriving in New York, I was driving down the road a few hundred feet from my rented house. I was stopped by the police for an improperly "affixed" to the front license plate, it was in the windshield as there is no front mounting place on my car. 

When the officer stopped me and asked for license and registration, the police officer saw my out of state "concealed carry permit and my life was devastated in an instant." 

The officer decided my CCW permit meant I was armed and dangerous and although I obeyed all instructions and was polite and courteous, he unconstitutionally searched my car,  arresting me for possession of my regular and backup FFL dealer, lawfully purchased handguns. 

During my traffic stop, I videoed the interactions with the officer. When the officer searched the vehicle, he deleted the video. (We were, however, able to recover fragments with the help of Northeastern Cyber Data Recovery). Until we let the DA's office see the recovered footage they denied that the officer had a  DashCam video. We now have detailed footage and audio recording of everything that transpired. I strongly recommend everyone get a dashcam it is invaluable on those occasions we badly need it (traffic stop, car accident, vandalism, someone hitting your parked car) This one uploads directly to the cloud so it cant be deleted by someone and you can monitor your kids while they are actually driving etc  
 
For the past two years, I have spent ten's of thousands of dollars fighting the illegal search of my car and the breach of my constitutional rights, I was out on $50,000 bail and with a violent felony indictment even though I was polite courteous and never hurt or harmed anyone.

WHY THIS MATTERS FROM A BIGGER PICTURE AND HOW IT COULD IMPACT YOUR LIFE

This isn't just about me and my kids this is actually a far bigger issue. This case is a landmark case with far-reaching implications in New York and potentially around the country

This is about whether a form of identification (such as a conceal carry permit, pharmacy license, medical marijuana card, security guard license, police officer identification, etc) can constitute reasonable suspicion to enter and search a vehicle (i.e reducing your rights). This is a direct attack on constitutional rights to be free from search and if lost could be an expansion of the police discretionary power granted under the automobile exception.

WHAT THIS HAS COST ME AND MY CHILDREN:

The costs of this arrest on my life and my children's lives have been immeasurable: 

a) I lost my business and all forms of income. - I had just moved to a new city, started an exciting new business, and it was growing nicely, my investors withdrew their money with a pending Violent Felony Arrest and pending jail time hanging over my head. My suppliers who had long-term service agreements are all coming after me for payment so I owe them many hundreds of thousands of dollars.

b) I lost my house in Colorado as I couldn't make my mortgage payments. - The bank is still coming after me for my personal guarantee on the house and wants over $1m with legal fees and exorbitant interest. 

c) The Police contacted my children's school and tried to take away my children because anyone with a concealed carry permit and who owns guns is a bad or dangerous parent.

d)  My body succumbed to the pressure and my health began to fail me due to the endless stress, financial hardship, potential loss of my children and suffered medical issues with both my heart and Angioedema. 

e) The legal expenses for my defense have been many ten's of thousands and I was unable to work depleting all my life savings

HOW YOU CAN HELP?

1) I am asking for your help as to pay my lawyers for their incredibly hard work on my behalf and on the half of gun owners and concealed carry permit holders everywhere.

To date, this is over $100,000 

4) Your continued generosity, we will use the extra money to pay to defense and appellate lawyers for others who are facing similar charges and can't afford to defend themselves or are in prison as a result of such charges and can't afford an appeal. 

5) You can also write to your state senator asking them to pass SB 446, The Constitutional Concealed Carry Reciprocity Act of 2019. Write to your congressman and ask them to again support HB 38. Together we can change the laws to make a concealed carry permit a nationwide accepted document much like a driving license.   

6) Write to your senators and congressmen requesting that they create expungement statutes allowing for those wrongfully arrested to not just have their cases sealed but all records of the arrest expunged.
