In the Spring of 2018, I was terminated from the piercing shop I was employed at for removing a nazi from the shop.
After asking them to leave, they retaliated against the business by doxxing me and orchestrating a complete smear campaign on the shop’s business pages, leaving 1-star reviews and spreading lies about myself and the other piercers employed there. As a result, I was terminated.
As a condition of my apprenticeship, I was required to sign a no-compete contract that stated that should I leave the employment of my boss for any reason (including termination), I would be required to find employment outside of a 90-mile radius from the shop. I live in a small town. This effectively bans and bars me from gainful employment in my industry in my entire town and three major cities in the surrounding area.
After my termination, I traveled extensively for work, attempting to abide by the terms of the agreement. For six months I was able to make it work, but then the money ran out and, out of any viable options, I returned home. I took up employment at a piercing shop in my town out of a need to feed myself and worked there for 4 months.
After four months of employment, I received a phone call from my previous employer’s lawyer telling me that I was in violation of the non-compete contract and that they would be seeking $30,000 “for loss of business” in a settlement, or the matter would go to court.
I now am forced to drive 102 miles to AND from work in the nearest town outside of the no-compete DAILY, draining my resources and making it incredibly difficult to maintain any sense of a stable livelihood, and am now facing rising legal fees in order to tackle this matter in what looks like it might be a lengthy court battle.
