18 years ago, at age 22, Nelly Cumbicos arrived in the United States to be with her family who had escaped Ecuador years earlier under death threats. While crossing the border, she and some other young women were kidnapped by banditos and held hostage for money. As the women were being relocated to another hiding spot, a motor vehicle accident occurred, and the police rescued the women. Because the women were undocumented, the border patrol got involved and Nelly was relocated to CT to be closer to her family with instructions that ICE would be getting in touch with her. This never happened.
Nelly lived with her family, gave birth to a son named Jim and raised her son with assistance from her family. She loves being a mother. In 2013, she met a wonderful man named Ramon, who is a U.S. citizen. Nelly and Ramon were married in 2015.
Two years later, Nelly applied for U.S. citizenship. At that time, it was discovered she had been given a deportation order in 2002 for failure to appear in court. Nelly had been unaware of that court date. She was given a new deportation date of June 30, 2017. She applied for, and received, a temporary stay of removal which allowed her to remain in the country for another 6 months.
Throughout her ordeal, Nelly has been very cooperative with the authorities. She attends all her check-ins with Immigration and Customs Enforcement in Hartford. She has never committed a crime. Her Marriage Petition for permanent residency from Immigration was approved and she has a pending waiver for her removal order of 2002. Once this waiver is approved, she will be able to be given permanent residency.
BUT ICE DOESN'T WANT TO WAIT.
At her December appointment with ICE, she was instructed to bring in a plane ticket for a February 16, 2018 deportation date. A GPS ankle bracelet was applied, and she is now under 24-hour supervision. After her lawyer filed for a review at the Second Circuit, ICE backed off for three days - and then in a shocking move, told Nelly they were NOT going to respect the Second Circuit's jurisdiction, and gave her a new deportation date of February 28.
Nelly is a mother and a wife who loves her family. Her son is now a student in one of the state's Technical Schools studying computer science. He would be heartbroken if she is forced to leave. Her husband is a hard-working roofer, and a member of Local 9. Nelly and her family attend church weekly. Her family is like yours and mine. Please help Nelly and her family to remain together.
