Officer Stewart Ferrin,  of the Arizona State University Police Department, is being wrongfully terminated from the job he loves over his arrest of a University Professor for a misdemeanor traffic offense.

Although it has been commonly reported that the offense committed was a civil jay walking violation that is incorrect. Ms. Ore was arrested for the criminal act of Obstructing a Public Thoroughfare and during that arrest she resisted arrest and had to be physically restrained. This encounter was captured on the officer's dash cam and went viral on the internet.

The use of force by the police is never pretty. Officer Ferrin used great restraint in trying to subdue Ms. Ore until she wrapped her leg around his and tried to knock him off balance. At that time, Officer Ferrin had no choice but to take Ms. Ore to the ground.

Once Ms. Ore was in custody, she turned around and kicked Officer Ferrin in the shin.

She was arrested and booked into jail on various charges. The County Attorney reviewed the case and charged all counts and added one of their own; Resisting Arrest.

This matter was reviewed all the way up the chain of command at the ASUPD as well as by ASU General Counsel the following morning and all supported the actions of Officer Ferrin.

Six weeks passed with Officer Ferrin continuing to perform his regular duties. Only after Ms. Ore took her case to the media did the ASU Administration take any action.

Bowing to public pressure, on July 1st, 2014, the University placed Officer Ferrin on paid administrative leave. A week later he was given the choice, essentially resign or be fired. Officer Ferrin did not resign.

Meanwhile, Ms. Ore, with the assistance of a defense attorney, eventually agreed to a plea deal. In the plea, she agreed to the facts of the case as alleged and was convicted of Resisting Arrest.

The judge sentenced her to more punishment than the State requested, being 9 months probation, 50 hours of community service, and an anger management class.

Additionally, the FBI conducted their own review of this matter and cleared Off. Ferrin of any wrong doing, including Excessive Force and Racial Profiling as was originally alleged.

Now, ASU is claiming the arrest was unlawful and has been on a witch hunt for 6 months.

Officer Ferrin is a family man. He has a beautiful wife and two year old daughter. His second daughter is due to be born in three weeks. If terminated, he will lose his income and his health insurance. Meanwhile substantial legal bills are piling up while he fights the machine at ASU.
