Judge Denies Veteran His Rights
Activist Judge denies an elderly Veteran of his Constitutional Rights -- Starts foreclosure on his home. Please Help by donating whatever you can. Needed amount to STOP the sale of his home is roughly $12,000.
This fundraiser is for an 84 year old Air Force Veteran of the Korean War in Durham, NC
The short story: Our Korean Era Veteran recently discovered a little known Tax Statute on the state books. A reduced rate for folks over 65. This means, our vet has actually OVERPAID his taxes for the last 19 years. In those last 19 years, he’s overpaid his taxes by approx. $24,000.
Our Veteran sent a letter to the local 'Tax Office' asking for clarification. He received no response whatsoever.
5 months later, a letter came demanding ‘IMMEDIATE PAYMENT’ of the back taxes (delinquent for only 5 months). He responded again, simply asking questions that they hadn’t answered earlier. Again, no response from the tax office.
5 more months passed, mid October 2016, and our veteran is served with a ‘Civil Suit’ to start foreclosure on his property. He responded to this action stating numerous errors in the suit, and that he requested his Constitutional Right to a ‘Trial by Jury’ (US Constitution 6th & 7th Amendments – The State Constitution also guarantees this right in all civil cases).
The civil suit 'Document' wasn't even 'SIGNED' by a clerk of court, magistrate, nor a judge.
On January 27th, 2017, he received a notice that his property is “… hereby barred and forever foreclosed, except his to his/her right to redeem before confirmation of the sale…” --- This is a court order by an activist judge in Durham County NC. His rights were completely ignored.
There is a whole lot more to this story – but time is of the essence to save his home. His home is scheduled to be sold on March 14, 2017. He is currently seeking other avenues. And if the sale goes thru before any ‘Legal Actions’ get made, then his home is lost forever.
