I woke up to a banging on the window around 5 am. It was my uncle, he told me that my mom was detained by I.C.E. The situation is rough to say the least because my mom had 2 non violent felonies, where she commited burglary a long time ago. Under penal code 459. Meaning she went to a bank or a store and used or intended to use a fake check. She was in an abusive relationship with a man who would threaten her to go into the bank and cash a blank check. This happened in California and these cases are wobblers meaning it can either be viewed as a misdemeanor or as a felony. Depending on how good your lawyer is. Unfortunately for my mom the lawyer she had could not drop the charges to a misdemeanor. To make this first portion of the story short, in 2014 she was taken into custody and she was in kent county jail. She stayed there for about a month or 2 and then was extradited to California where she then served her time which was about 3 more months and took care of the problem and she was released because they looked at her over the years being an asset to her community and a good person. She raised my brother and I alone. We have no criminal background, have completed high school, continuing to finish college even with all the adversity we've been dealt with. She had shaped us to become the men we are today. So fast forward back to the present. This felony has been brought up again. I.C.E. had been camped out of our house and as she was on her way to work she was pulled over and taken in. I just recently went to see a lawyer by the name of Marielo Puerta, she informed me because of this felony this situation is nearly impossible to handle. Even though her visa expired she did come here legally and my brother who is a citizen could have made the problem easy to fix. Although, with the felony and how strict the rules and how crazy things have gotten with Trump being president it makes this nearly impossible as she said. So now I will have to wait until sometime next month when she will have a bond hearing and pray for a miricale. If she is granted that bond I will use the money to pay for that. This time because of how hard immigration is due to Trump my lawyer believes that they won't just take into account that she changed overtime. If she is not there are two pther possibilities. One, she sits in jail until we reopen a case with California and we fight it, but this could take a month, a year, or more. It's unknown, but with this option if she chooses I will spend the money on the lawyer and what not. The second possibility is she could voulantarily sign to just be sent back to El Salvador and live there until she is able to return to the States in 10 years. If this is the outcome I will use the money to help pay off her bankruptcy to keep the house she worked so hard to own. The house being collateral.
I personally am at a loss with what to do, I hope for the best, but I expect the worst.
