Getting my nephews back

Hi I’m setting up this go fund me in hopes to raise money to hire an attorney to help get my nephews back. In 2014 my then 17-year-old brother became a father for the first time he and his girlfriend had my nephew Christian. Two years later they welcomed my youngest nephew Trey.  My brother met his girlfriend in school she was already a mother of two and he came along and decided to be a parent to the two children she currently had and they together had two more children. My brother was young just a teenaged kid. However, you couldn’t tell him he was a kid believe me we tried. He was nowhere near ready for the responsibility he attempted to take on. Managing a house with four small children proved to be too much for him and his girlfriend. One night Trey the youngest baby was very fussy and would not stop crying my brother became overwhelmed with trying to soothe the baby and he ended up shaking the baby. This is the worst scenario you could imagine in a situation like this two teenage parents four children in over their heads.  The baby Trey began to have a seizure and they took the baby to The hospital. Child protective services got involved and removed all the children from their care.  That day my mother was contacted and guardianship was granted to her for my two nephews and the other children went to my brothers girlfriends mom. Who the girlfriend ended up living with. My baby nephew Trey was in the hospital.  (He pulled through and is fine). My mom who has been a child care worker for over 30 years was not able to get off work to stay home with my nephew Christian so he came to my house with me and my 2 older kids. At this time I was going through my own struggles my gas had been disconnected and I was forced to use a space heater to warm my apartment. While at my house my nephew Christian backed into the heater burning his calf. Both my brother and his girlfriend were there when the accident with the heater occurred. They immediately went to Walgreens to get supplies to treat his burn. We bandaged him up and the next day he had a mandatory doctors appointment which is why we didn’t feel the need to go to an ER for the burn. He was acting normal and was playing and laughing so we felt it would be ok to wait until his doctors appointment the next day. At the appointment everything hit the fan. Child services removed my nephew from my care and my mothers care saying we should’ve taken him to the ER the night before and my brother was not supposed to be with the child at my house which no one told me. They literally just dropped my nephew on my doorstep and left. My brother went to the police station and ended up confessing to the police that he shook his baby and was arrested. He’s currently serving 5 years in prison for his crime. He was 19 years old. Still a child himself. My brother has taken responsibility for what he did. He never wanted to hurt his son he just got overwhelmed. And he loves his sons very much and misses them every day. A couple days ago he went to family court and learned that his parental rights are being terminated and his girlfriend is giving up his sons to the system permanently. The judge told his public defender he can’t get his sons back because he didn’t complete a parenting class which was impossible due to him turning himself in and being imprisoned. The public defender hasn’t been any help at all. It’s been years since we seen my nephews. We were under the impression that their mother had gotten them back but she hasn’t been responsive to attempts to contact her. Now we’re learning that they are going to be adopted into another family. My mother and I want to fight for them. They are our family and we love them. In the 4 years since this happened I have bought my first home and started working in a field I love. However, due to this pandemic I was laid off. Which is why we’re asking for help. Please if you find it in your hearts to assist with anything towards a legal fund to hire a real lawyer for my brothers next family court date on January 28th  we will be more than appreciative as a family. Please help bring Trey and Christian home. Their mother doesn’t want them but aunty and grandma definitely wants them! I know some people will feel differently about this situation and I understand that point of view fully. Just know we will never stop fighting to get my nephews back.
