We began our educational courses with Swinburne before 2016. Our contracts were clear: do a, b and c in exchange for your degree. Then in 2016, citing a govt requirement (Lantite) they told us us we now had to do this govt requirement to graduate.
The govt did not implement in nationally or state wide but told universities they can implement it how they want and it only became a legal ministerial requirement from 2019.
There is a letter from the Minister of Education James Merlino that you need Lantite if you began your course from 2017. Some of us began before 2017 ( thus breach of contract) and some after but Swinburne did not tell them on enrollment (another breach of contract).
Swinburne has also withdrawn some of us from our courses despite finishing them yet not graduating ( another breach of contract). Swinburne has been keeping
our Bachelor and Master educational degrees illegally.
As a business with an Australian Business Number (ABN) Swinburne should be
legally bound to Australian Consumer Law especially as they advertise like one.
Some of us finished our degrees in 2018 ( 2 yrs ago!) and have been doing what we can to get by but demand justice from Swinburne over this clear illegality. Years of study and we have nothing positive for our efforts. All we have now is a large university debt and no work despite this govt claiming it needs educators in the classroom.
It's shameful that the government avenues we have tried to contact for years haven't been interested and all give us a standard response.
In order to take Swinburne to court we need to raise the legal fees for our lawyer. 100% of the funds raised will go to them.
In addition to all of this, our mental health has suffered greatly. Some of us had
our mental health issues exacerbated because of this mental hell while others have had mental health issues introduced into their lives. Our mental health issues range from diagnosis of anxiety to PTSD and suicidal thoughts.
As it has been 2 years for some of us, we would appreciate it you could share this page far and wide so we can begin legal proceedings against Swinburne immediately and receive justice against them.
We want these years of mental and physical suffering behind us so this no longer hurts us or our families and we have the ability to be free from these illegal constraints and are able to be free and move on.
This fight will also help other students who are in their courses now if Swinburne tries to breach their contracts and hopefully deters others from choosing them.
