<div>Ceux et celles qui n’ont eu d’autre choix que de fuir vers les pays voisins, avec un avenir incertain ; celles et ceux qui se cachent, incapables de subvenir à leurs besoins ou de s’assurer un repas quotidien ; celles et ceux qui sont emprisonnés et ont besoin d’une aide de base (nourriture, vêtements et argent de poche) pour pouvoir faire face aux difficultés quotidiennes en prison ; celles et ceux qui ont été agressés et ont besoin de soins médicaux.

<div><strong>Situation d'urgence pour les personnes Queer au Sénégal :</strong>

<div>Le lundi 30 mars, le président sénégalais Bassirou Diomaye a promulgué la loi n° 2026-08, modifiant comme suit l'article 319 du Code pénal du 21 juillet 1965 : « toute représentation publique, que ce soit par la parole, l'écriture, l'image, le geste, le son ou tout autre moyen quel qu'il soit, visant à promouvoir l'homosexualité, la bisexualité, la transsexualité, la zoophilie, la nécrophilie ou toute autre pratique similaire. » Adoptée par l’Assemblée nationale le 11 mars 2026, par 135 voix pour, 3 abstentions et aucune voix contre, cette loi ne se contente pas de criminaliser explicitement l’homosexualité, la bisexualité et la transsexualité, elle punit également toute personne ou organisation qui entreprend une action visant à défendre ou à humaniser les personnes queer au Sénégal. L’association, dans cette loi, de l’homosexualité, de la bestialité, de la nécrophilie ou de toute autre pratique similaire constitue une confusion délibérée et dangereuse. « Le groupe américain MassResistance, connu pour ses efforts aux États-Unis en faveur de lois visant les personnes LGBTQ+, conseille depuis des années des militants africains partageant les mêmes idées », écrit Reuters, révélant une collaboration entre MassResistance et And Samm Jikko Yi – le principal groupe anti-droits au Sénégal – depuis décembre 2024. La nouvelle loi stipule que « toute personne qui commet un acte contre nature est punie d’une peine d’emprisonnement de 5 à 10 ans et d’une amende de 2 000 000 à 10 millions de francs CFA, sans préjudice des peines prévues en cas de viol ou de pédophilie ».

<div>Alors que la loi faisait l’objet de débats en tant que promesse électorale, la violence s’était déjà déchaînée contre divers « suspects ». Un adolescent de 17 ans, joueur de tam-tam, a été poignardé à mort par une foule parce qu’il était soupçonné d’être homosexuel. Dans l’histoire récente, des tombes ont été profanées sur la base de soupçons d’homosexualité. Maintenant que la loi a été adoptée, on a l’impression que la violence à l’encontre de la communauté LGBTQ+ n’a plus de limites. Plus d’une centaine de personnes ont été arrêtées, d’autres se sont suicidées, beaucoup se sont cachées, abandonnant leur travail et leur famille, et donc leurs réseaux de sécurité. Les personnes séropositives, qu’elles soient queer ou non, sont particulièrement en danger, car leurs dossiers médicaux sont considérés comme des preuves de leur culpabilité. En conséquence, ces personnes déjà fragiles interrompent leurs traitements et mettent en danger leur vie et leur entourage immédiat.

<div>La crainte d’une arrestation et/ou d’une justice populaire punitive est omniprésente. Ce niveau de violence a été encouragé par les appels à la violence et les discours haineux émanant des autorités gouvernementales, de groupes de la société civile tels que « And Samm Jikko Yi » et des médias. Certaines personnalités médiatiques et d’autres membres de la société civile extrémiste adoptent une rhétorique extrême et vont jusqu’à réclamer la peine de mort contre les personnes LGBTQ+ au Sénégal.

<div><strong>Face à cette situation, nous essayons de venir en aide aux plus vulnérables :</strong>

<div>De plus, comme nous ne pouvons pas partager cette campagne depuis le Sénégal, nous demandons à toutes les personnes libres de ce monde de la diffuser en notre nom, afin qu'elle parvienne à celles et ceux qui ont les moyens de nous soutenir financièrement, jusqu'à ce que nous puissions nous remettre sur pied.

<div><strong>Emergency situation for queer people in Senegal</strong>

<div>On Monday, March 30, Senegalese President Bassirou Diomaye signed into law Act No. 2026-08, amending Article 319 of the Penal Code of July 21, 1965, as follows: “any public representation, whether through speech, writing, images, gestures, sound, or any other means whatsoever, intended to promote homosexuality, bisexuality, transsexuality, zoophilia, necrophilia, or any other similar practice.” Passed by the National Assembly on March 11, 2026, with 135 votes in favor, 3 abstentions, and no votes against, the law does not only explicitly criminalize homosexuality, bisexuality, and transsexuality, it also punishes any person or organization that takes any action aimed at defending or humanizing queer people in Senegal. The association in this law of homosexuality, bestiality, necrophilia, or any other similar practice constitutes a deliberate and dangerous conflation. «The American group MassResistance, known for its efforts in the United States to push for laws targeting LGBTQ+ people, has been advising like-minded African activists for years. », writes Reuters revealing a collaboration between MassRessistance and And Samm Jikko Yi - the leading anti-rights group in Senegal - since Decembere 2024. The new law stipulates that “any person who commits an unnatural act shall be punished by imprisonment for 5 to 10 years and a fine of 2,000,000 to 10 million CFA francs, without prejudice to the penalties provided for in cases of rape or pedophilia.”

<div>As the law was discussed as a presidential campaign pledge, the violence was already unleashed on different “suspects”. A 17-year-old boy, a tam-tam drummer, was stabbed to death by a mob because he was suspected of being homosexual. In recent history, graves have been desecrated on suspicion of homosexuality. Now that the law has passed, it feels like there is no limit to the violence against the LGBTQ+ community. More than a hundred individuals have been arrested, others committed suicide, many went into hiding, leaving their jobs and families, and thus their safety networks behind. Persons with HIV, queer or not, are particularly at risk, as their medical records are considered evidence of their culpability. Consequently, the already frail, interrupt their treatments and put at risk their lives and their direct surroundings.

<div>The fear of arrest and/or punitive mob justice is omnipresent. This level of violence has been encouraged by calls for violence and hate speech from government authorities, civil society groups such as And Samm Jikko Yi, and the media. Certain media figures and other members of extremist civil society are adopting extreme rhetoric and going as far as to call for the death penalty against LGBTQ+ people in Senegal.

<div><strong>In light of this situation, we are trying to support the most vulnerable in this situation:</strong>
