Amber & Mike Kellogg-Barbeau and their 2 children have been trying to build a small home in Westhampton, MA since before March of 2017. The long story short in the end they were denied a variance in the town meeting tonight and their choice is to remove the old foundation, blast ledge & pour a new foundation or appeal and take the town to court. Either direction is extremely costly and they can’t afford to pay on the existing construction loan and come up with these funds with out our help!!
Short story Long below...
Amber & Mike went through the proper channels “so they thought” as advised by the Town of Westhampton and on April 25, 2017 they were issued a Building Permit. June 5th (41 Days after the 30 day appeal time span) a town resident appealed the building permit stating they did not have a legal building lot. This lot was gifted from family and was grandfathered building lot but was missing frontage. After many town meetings and many hoops jumped Amber & Mike were able to scrape funds together to purchase additional frontage to make it legal. June 23rd their foundation was poured. And their home was already ordered... all this thinking now they had the frontage with a grandfathered building lot so they were set. WELL.... no it turns out the foundation was 4’ too close to their property line. So on August 23rd they received a cease & desist order but the home was already in transport and delivered 2 Days later. They filed a variance appeal and waited for tonight’s meeting 11/28/17 was the Zoning Board Meeting. Many towns people came and spoke in favor of the variance and 2 spoke against, at meetings end the board Voted 3 for the variance and 2 opposed... so Denial and puts us back to the choices above.
If you know this family you know their health is hurting and have had the worst run of bad luck over the years. Let’s help them put their home on a foundation!
